S.I. No. 637/2020 - Statistics (Census of Population) Order 2020


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th December, 2020.

I, MICHEÁL MARTIN, Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993) and, in relation to paragraphs 1(a) to (g), 2(b) to (j), (w)(ii) to (x)(iv), (y) and (z), 3(b) to (f), 4(b) to (h) and 5 of the Schedule to the following order, for the purpose of giving full effect to Regulation (EC) No. 763/2008 of the European Parliament and of the Council of 9 July 20081 , hereby order as follows:

1. This Order may be cited as the Statistics (Census of Population) Order 2020.

2. (1) In this Order -

“census night” means the period of time commencing at 9 p.m. on 3 April 2022 and ending at 7 a.m. on 4 April 2022;

“following morning” means the period of time commencing at 7 a.m. on 4 April 2022 and ending at noon on that day;

“Regulation” means Regulation (EC) No. 763/2008 of the European Parliament and of the Council of 9 July 20081 ;

“residential communal establishment” means a residential communal establishment of any kind, excluding private households, and includes -

(a) a hospital,

(b) a residential facility for persons with intellectual or physical disabilities, or both,

(c) a nursing home,

(d) a children’s home,

(e) student specific accommodation,

(f) a religious community,

(g) a defence establishment,

(h) a prison,

(i) a shelter or refuge,

(j) a hotel,

(k) a boarding house,

(l) a guest house,

(m) a bed and breakfast,

(n) a hostel, and

(o) a campsite.

(2) A word or expression that is used in this Order and also used in the Regulation has the same meaning in this Order as in the Regulation, except where the context otherwise requires.

3. A requirement on the householder or any adult member of a private household to provide -

(a) in respect of the private household that is occupied by the person on census night or the following morning, he or she not having been enumerated elsewhere on that night or morning, information the general nature of which is specified in paragraph 1 of the Schedule,

(b) in respect of each person who is alive and in the State at midnight on Sunday 3 April 2022 and who occupies the private household on census night or the following morning, the person or persons not having been enumerated elsewhere on that night or morning, information the general nature of which is specified in paragraph 2 of the Schedule,

(c) information as to whether any or all members of the private household are temporarily absent from the household on census night and the following morning,

(d) where all members of the private household are temporarily absent from the private household on census night and the following morning, in respect of each member of the household who is so absent, information the general nature of which is specified in paragraph 3 of the Schedule, and

(e) where some but not all members of the private household are temporarily absent from the private household on census night and the following morning, in respect of each person who is so absent, information the general nature of which is specified in paragraph 4 of the Schedule,

is hereby prescribed.

4. A requirement on -

(a) the manager or other person in charge of a residential communal establishment, and

(b) the master or other person in charge of a vessel (other than a vessel comprising a private household) in any harbour, port, bay, creek, lake, river, canal or elsewhere in waters within the jurisdiction of the State,

to provide, in respect of the residential communal establishment or vessel, as the case may be, information the general nature of which is specified in paragraph 5 of the Schedule, is hereby prescribed.

5. A requirement on a person in respect of whom the information specified in paragraph 2 of the Schedule -

(a) is not required by this Order to be provided by another person, or

(b) is not likely to be provided by another person,

to provide, in respect of himself or herself, information the general nature of which is specified in paragraph 2 of the Schedule, is hereby prescribed.

SCHEDULE

General nature of information to be provided for purposes of Census of

Population to be conducted in year 2022

1. Information regarding the following housing characteristics and facilities of a private household referred to in Article 3(a) on census night or the following morning:

(a) age of building;

(b) type of dwelling;

(c) whether the accommodation is owned or rented and, where the accommodation is rented, category of landlord;

(d) number of rooms;

(e) type of fuel used by central heating;

(f) type of piped water supply;

(g) type of sewerage facilities;

(h) where the accommodation is rented, the amount of rent paid and frequency of such payment;

(i) number of working smoke alarms;

(j) whether the accommodation uses renewable energy sources;

(k) number of cars or vans owned or available for use by members of the household;

(l) type of internet connection and type of devices used to access the internet.

2. Information regarding the following, as it relates to each person to whom Article 3(b) or 5, as the case may be, applies on census night or the following morning:

(a) first name and surname;

(b) sex;

(c) date of birth;

(d) in the case of a person who occupies a private household, relationship to each other person who occupies the household on census night or the following morning;

(e) in the case of a person who has attained the age of 15 years, marital status;

(f) place of birth;

(g) usual residence;

(h) usual residence on 3 April 2021;

(i) whether the person has lived outside the State for a continuous period of a year or more and, if so -

(i) country of last previous usual residence, and

(ii) year of last taking up residence in the State;

(j) country of citizenship;

(k) ethnic group or ethnic background;

(l) religion;

(m) in the case of a person who has attained the age of 3 years, ability to speak the Irish language and, if so able, frequency of speaking and level of Irish and, where Irish is spoken daily, whether it is so spoken within or outside the education system;

(n) whether a language other than English or Irish is spoken by the person at home and, where it is, the language concerned and the person’s ability to speak English;

(o) health, including any long-lasting conditions or difficulties and the extent and effect of any such conditions and difficulties;

(p) whether tobacco products are used and, if so, the frequency of such use;

(q) usual means of travel for the journey from home to work, school, college or childcare;

(r) usual time of leaving home for work, school, college or childcare;

(s) time taken for the journey referred to in subparagraph (q);

(t) usual time of leaving work, school, college or childcare to return home;

(u) whether the person provides regular, unpaid personal help or support to another person and, where so provided, the number of hours so provided per week;

(v) whether the person regularly engages in unpaid help or voluntary work in a social or charitable organisation, a religious or church group, a sporting organisation, a political organisation or his or her community;

(w) in the case of a person who has attained the age of 15 years -

(i) whether his or her full-time education has ceased and, where it has, the age at which it ceased,

(ii) the highest level of education and training completed, and

(iii) present principal economic status;

(x) in the case of a person who has attained the age of 15 years who is employed -

(i) employment status,

(ii) occupation and, where the occupation is that of farmer, the size of the area farmed,

(iii) business of employer or in the case of a person who is self-employed, his or her own business,

(iv) name and address of place of work, and

(v) whether the person ever works from home and, if so, the number of days so worked per week;

(y) in the case of a person who has attained the age of 15 years who is unemployed -

(i) previous employment status,

(ii) previous occupation and, where the previous occupation was that of farmer, the size of the area previously farmed, and

(iii) previous employer’s business or in the case of a person who was self-employed, his or her own business;

(z) in the case of a person who has attained the age of 15 years who is retired -

(i) previous employment status, and

(ii) previous occupation and, where the previous occupation was that of farmer, the size of the area previously farmed;

(aa) in the case of a person attending school or college, name and address of school or college, as the case may be;

(bb) in the case of a person who has not attained the age of 15 years, whether the person is in childcare, and if so-

(i) name and address of childcare provider,

(ii) type of childcare, and

(iii) number of hours spent in childcare per week during term-times.

3. Information regarding the following, as it relates to each person to whom Article 3(d) applies on census night or the following morning:

(a) first name and surname;

(b) sex;

(c) date of birth and age;

(d) country of citizenship;

(e) in the case of a member of the household who was not in the State, the country where he or she resided;

(f) in the case of a member of the household who was in the State, the address at which he or she resided.

4. Information regarding the following, as it relates to each person to whom Article 3(e) applies on census night or the following morning:

(a) first name and surname;

(b) sex;

(c) date of birth;

(d) relationship to each other person who occupies the private household on census night or the following morning;

(e) in the case of a person who has attained the age of 15 years, marital status;

(f) length of absence from household;

(g) whether or not in the State;

(h) country of citizenship.

5. Information regarding the following as it relates to a residential communal establishment or vessel, as the case may be, referred to in Article 4, on census night or the following morning:

(a) type of residential communal establishment or vessel, as the case may be;

(b) first name and surname of the persons who are alive and in the State at midnight on Sunday 3 April 2022 and occupy the establishment or vessel, as the case may be;

(c) confirmation in respect of each person referred to in subparagraph (b) as to whether an individual form was issued to and collected from the person by the manager or other person in charge of the establishment or by the master or other person in charge of the vessel, as the case may be.
