S.I. No. 262/2018 - National Milk Agency (Conduct of Elections) (Amendment) Regulations 2018


Notice of the making of this Statutory Instrument was published in

I, MICHAEL CREED, Minister for Agriculture, Food and the Marine, in exercise of the powers conferred on me by section 20 of, and paragraph 5(5) (as amended by section 4 of the Milk (Regulation of Supply) (Amendment) Act 1996 (No. 41 of 1996)) of the Schedule to, the Milk (Regulation of Supply) Act 1994 (No. 25 of 1994) (as adapted by the Agriculture, Fisheries and Food (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No.455 of 2011 )), hereby make the following regulations:

1. These Regulations may be cited as the National Milk Agency (Conduct of Elections) (Amendment) Regulations 2018.

2. The National Milk Agency (Conduct of Elections) Regulations 1997 ( S.I. No. 185 of 1997 ) are amended by:

(a) substituting for Regulation 4(2) (as amended by the National Milk Agency (Conduct of Elections) (Amendment) Regulations 2015 ( S.I. No. 400 of 2015 ), the following-

“(2)(a) The registered producers who have supplied raw milk for heat treatment for liquid consumption to-

(i) Glanbia Foods Ireland Ltd.,

(ii) LacPatrick Dairies Ltd.,

(iii) Aurivo Co-operative Society Ltd.,

(iv) Glenisk Ltd.

comprise a constituency and are entitled to elect 3 producer members to the Board of the National Milk Agency, and

(b) the registered producers who have supplied raw milk for heat treatment for liquid consumption to—

(i) The Village Dairy Ltd.,

(ii) Bainne Codladh Ltd.,

(iii) Arrabawn Co-operative Society Ltd.,

(iv) Clona Dairy Products Society Ltd.,

(v) Dairygold Co-operative Society Ltd. (as agent for Glanbia plc.),

(vi) Dawn Dairies Ltd. and Kerry Creameries Ltd., T/a Kerry Agribusiness — Dairies,

(vii) Lee Strand Co-operative Creamery Ltd.,

(viii) North Cork Co-operative Society Ltd.,

(ix) Centenary Thurles Co-operative Society Ltd.

comprise a constituency and are entitled to elect 2 producer members to the Board of the National Milk Agency.”

(b) substituting for Regulation 28(1), the following-

“(1) At the hour of 10am, or as soon as possible after that time, on the next working day following the day fixed by the returning officer for the close of the poll and at the office of the Agency, the returning officer shall open the ballot boxes.”.
