S.I. No. 174/2018 - Data Protection Act 2018 (Commencement) Order 2018


Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 29th May, 2018.

I, CHARLES FLANAGAN, Minister for Justice and Equality, in exercise of the powers conferred on me by section 1 (3) of the Data Protection Act 2018 , hereby order as follows:

1. This Order may be cited as the Data Protection Act 2018 (Commencement) Order 2018.

2. The 24th day of May 2018 is appointed as the day on which sections 1 and 9 of the Data Protection Act 2018 shall come into operation.

3. The 25th day of May 2018 is appointed as the day on which the Data Protection Act 2018 , other than—

(a) section 7(3) (insofar as it relates to the revocation of the Data Protection Act 1988 (Section 5(1)(d))(Specification) Regulations 1993 ( S.I. No. 95 of 1993 ), insofar as those Regulations relate to the functions of the Central Bank of Ireland to which Regulation 3 of those Regulations applies),

(b) section 25,

(c) section 30, and

(d) section 176(b),

insofar as it is not already in operation, shall come into operation.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

This Order appoints

• the 24th of May 2018 as the day on which sections 1 and 9 of the Data Protection Act 2018 come into operation; and

• the 25th of May 2018 as the day on which all remaining provisions, other than sections 7(3) (insofar as it relates to the revocation of the Data Protection Act 1988 (Section 5(1)(d))(Specification) Regulations 1993 ( S.I. No. 95 of 1993 ), insofar as those Regulations relate to the functions of the Central Bank of Ireland to which Regulation 3 of those Regulations applies), 25, 30, and 176(b), come into operation.
