I, MARY MITCHELL O’CONNOR, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 20091 , hereby make the following regulations: | ||
1. (1) These regulations may be cited as the European Communities (Safety of Toys) (Amendment) Regulations 2016. | ||
2. Regulation 48 of the European Communities (Safety of Toys) Regulations 2011 ( S.I. No. 14 of 2011 ), is amended by substituting for paragraph (9) the following paragraph— | ||
“(9) A person who contravenes Regulation 35 commits an offence”. | ||

These Regulations rectify a mistake in a cross-reference in Regulation 48(9) of S.I. 14 of 2011 which transposed Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 relating to toy safety. Regulation 48(9) had mistakenly referred to Regulation 36 instead of Regulation 35. | ||
