S.I. No. 119/2016 - Residential Tenancies (Amendment) Act 2015 (Commencement of Certain Provisions) Order 2016.


Notice of the making of this Statutory Instrument was published in

I, ALAN KELLY, Minister for the Environment, Community and Local Government, in exercise of the powers conferred on me by section 1 (4) of the Residential Tenancies (Amendment) Act 2015 (No. 42 of 2015), hereby order as follows:

1. This Order may be cited as the Residential Tenancies (Amendment) Act 2015 (Commencement of Certain Provisions) Order 2016.

2. The 1st day of March 2016 is appointed as the day on which the following provisions of the Residential Tenancies (Amendment) Act 2015 (No. 42 of 2015) come into operation:

(a) section 27;

(b) sections 32 and 33;

(c) sections 39 to 41;

(d) sections 44 and 45;

(e) section 47;

(f) sections 49 and 50;

(g) section 51 other than paragraph (b) of subsection (1) of that section;

(h) section 52, insofar as it relates to the insertion of subsections (4) and (5) into section 115 of the Residential Tenancies Act 2004 (No. 27 of 2004);

(i) sections 54 to 56;

(j) paragraph (d) of section 60;

(k) paragraph (e) of section 60, insofar as it relates to the insertion of subsections (6) and (8) into section 135 of the Residential Tenancies Act 2004 (No. 27 of 2004);

(l) section 62 other than subparagraph (iii) of paragraph (b) of that section;

(m) sections 66 to 69;

(n) sections 86 and 87;

(o) the Schedule.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legalinterpretation.)

This Order appoints 1 March 2016 as the date on which specified provisions of the Residential Tenancies (Amendment) Act 2015 come into effect. These include provisions for a more streamlined mediation service to provide for faster and more efficient resolution of disputes, the separation of the quasi-judicial and governance powers of the Board of the PRTB and changes to the registration procedures. Among other things, the Order also provides for the repeal of section 126 of the Residential Tenancies Act 2004 .
