S.I. No. 331/2014 - Garda Síochána (Promotion) (Amendment) Regulations 2014.

I, FRANCES FITZGERALD, Minister for Justice and Equality, in exercise of the powers conferred on me by sections 121 and 122 of the Garda Síochána Act 2005 (No. 20 of 2005) (as adapted by the Justice and Law Reform (Alteration of Name of Department and Title of Minister) Order 2011 ( S.I. No.138 of 2011 )), after consultation with the Commissioner of the Garda Síochána and with the approval of the Government, hereby make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Promotion) (Amendment) Regulations 2014.

2. In these Regulations “Principal Regulations” means the Garda Síochána (Promotion) Regulations 2006 ( S.I. No. 485 of 2006 ).

3. These Regulations come into operation on the 23rd day of July 2014.

4. Regulation 12 of the Principal Regulations is amended by the substitution of the following for paragraph (4):

“(4)(a) Subject to subparagraphs (b) and (c), the third member of the board shall be appointed by the Commissioner and shall be—

(i) a chief superintendent, if the promotion is to the rank of sergeant,

(ii) an assistant commissioner, if the promotion is to the rank of inspector, and

(iii) the Commissioner or a deputy commissioner, if the promotion is to the rank of superintendent, chief superintendent or assistant commissioner.

(b) Where, in relation to the selection of members for promotion to the rank of superintendent, chief superintendent or assistant commissioner, a competition is commenced after the coming into operation of the Garda Síochána (Promotion) (Amendment) Regulations 2014 ( S.I. No. 331 of 2014 ), subparagraph (a)(iii) shall not apply and, instead, for the purpose of any such competition, the third member of the board to be appointed by the Commissioner shall be—

(i) the Commissioner or a deputy commissioner, if the promotion is to the rank of assistant commissioner, and

(ii) the Commissioner, a deputy commissioner or an assistant commissioner, if the promotion is to the rank of superintendent or chief superintendent.

(c) Subparagraph (b) shall not apply to a competition for the selection of members for promotion to the rank of superintendent, chief superintendent or assistant commissioner that is commenced after 1 January 2015.

(d) For the purposes of this paragraph, a competition is deemed to commence on the latest date on which candidates may enter the competition.”.

The Government hereby approve the making of the foregoing Regulations.
