I, RICHARD BRUTON, Minister for Jobs, Enterprise and Innovation, in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 20091 as amended by Commission Directive 2012/7/EU of 2 March 20122 , hereby make the following regulations: | ||
1. (1) These regulations may be cited as the European Communities (Safety of Toys) (Amendment) Regulations 2013. | ||
(2) These Regulations come into operation on 20 July 2013. | ||
2. The European Communities (Safety of Toys) Regulations 2011 ( S.I. No. 14 of 2011 ), are hereby amended by substituting for the definition of “Toy Safety Directive” in Regulation 4 (1) the following— | ||
“ ‘Toy Safety Directive’ means Directive 2009/48/EC of the European Parliament and of the Council of 18 June 20091 as amended, for the purpose of adaptation to technical progress, by Commission Directive 2012/7/EU of 2 March 20124.”, | ||
and by adding the following footnote thereto: | ||
“4 OJ No L 64, 3.3.2012, p.2”. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to Commission Directive 2012/7/EU of 2 March 2012, which amends, for the purpose of adaptation to technical progress, part III of Annex II to Directive 2009/48/EC of the European Parliament and of the Council of 18 June 2009 relating to toy safety by setting lower limits for cadmium levels in toys or components in toys which shall not be exceeded. | ||
