38.— (1) (a) All functions (other than functions under the Act of 1987) that, immediately before the establishment day, were vested in the dissolved body are transferred to An tSeirbhÃs.
(b) The functions conferred on the dissolved body by virtue of subsection (2) of section 4 of the Act of 1987 are transferred to An tSeirbhÃs.
(c) References in any enactment or instrument under an enactment to An Foras Ã?iseanna Saothair (howsoever described) shall be construed as references to An tSeirbhÃs save where other provision is made as respects the construction of the first-mentioned references by any enactment passed before the passing of this Act.
(2) This section shall come into operation on the establishment day.
