I, BRIAN COWEN, Taoiseach, in exercise of the powers conferred on me by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving further effect to Council Regulation (EC) No. 1165/98 of 19 May 1998 1 (as amended by Regulation (EC) No. 1882/2003 of the European Parliament and of the Council of 29 September 2003 2 , Regulation (EC) No1158/2005 of the European Parliament and of the Council of 6 July 2005 3 , Commission Regulation (EC) No. 1503/2006 of 28 September 2006 4 , Regulation (EC) No. 1893/2006 of the European Parliament and of the Council of 20 December 2006 5 , Commission Regulation (EC) No. 1178/2008 of 28 November 2008 6 , Commission Regulation (EC) No. 329/2009 of 22 April 2009 7 and Regulation (EC) No. 596/2009 of the European Parliament and of the Council of 18 June 2009 8 ), hereby order as follows:

1. (1) This Order may be cited as the Statistics (Monthly Industrial Inquiry) Order 2010.

(2) This Order is deemed to have come into operation on 1 February 2010 and shall cease to have effect on 31 January 2015.

2. This Order applies to an undertaking which is classified for statistical purposes under sections B, C, D, E and J of Nace Rev 2 set out in the Annex to Council Regulation No. 1893/2006 of the European Parliament and of the Council of 20 December 20065, which is required by the Office to participate in the survey.

3. An undertaking to which this Order applies is prescribed as an undertaking required to provide the Office with information relating to industrial activity, the general nature of which information is specified in the Schedule.

4. Information, the general nature of which is specified in the Schedule, is prescribed as information required to be provided for the purposes of surveys of undertakings to which this Order applies, the first of which surveys is to be taken in February 2010, or as soon as possible thereafter, relating to the period January 2010 and the last of which surveys is to be taken in January 2015, or as soon as possible thereafter, relating to the period December 2014.

5. The information referred to in Article 4 shall be provided, as requested by the Director General, at monthly intervals.

6. (1) Subject to paragraph (2), an undertaking required by this Order to provide information to the Office shall provide such information by the completion of forms and questionnaires prepared by the Director General in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

(2) An undertaking required by virtue of this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General, the information is furnished by electronic means, and provided that the Director General approves the format or manner in which the information is provided.

Schedule Information referred to in Article 3 to be provided by undertakings referred to in Article 2.

1.Particulars of the quantity of production and its net selling value for the period concerned.

2.Particulars of the value of turnover (excluding VAT) for the period concerned.

3.Particulars of the number of persons engaged in the undertaking on a specified reference week during the period concerned.

4.Particulars of the value of new orders for the period concerned.

5.Particulars of the monthly period covered by the return of the undertaking.

6.Particulars of the time taken to complete this Inquiry.
