STATISTICS (CENSUS OF INDUSTRIAL PRODUCTION) ORDER 2008

Notice of the making of this Statutory Instrument was published in

“Iris Oifigiúil” of 28th March, 2008.

The Taoiseach, in exercise of the powers conferred on him by section 25(1) of the Statistics Act 1993 (No. 21 of 1993) and for the purpose of giving full effect to Council Regulation (EC, Euratom) No. 58/97 of 20 December 1996 concerning structural business statistics 1 , hereby orders as follows:

1. This Order may be cited as the Statistics (Census of Industrial Production) Order 2008.

2. (1) Subject to paragraph (2) of this Article, this Order relates to information required to be provided by a date not later than 31 December 2012.

(2) For the purposes of paragraphs 4 and 5 of Schedule 1, undertakings to which either of those paragraphs relate shall not be required to provide information by virtue of paragraph (1) of this Article before 1 January 2009, unless the undertaking concerned is also an undertaking to which paragraph 1, 2 or 3 of Schedule 1 also relates and, accordingly, until that date, this Order only applies to undertakings to which the dais paragraphs 1, 2 and 3 relate.

3. Subject to Article 2(2), this Order applies to an undertaking that is engaged in any activity described in Schedule 1.

4. (1) An undertaking to whom this Order applies is prescribed as an undertaking required to provide the Central Statistics Office with information relating to industrial production, the general nature of which information is specified in Schedule 2.

(2) In paragraph (1) “information relating to industrial production” means information relating to an activity referred to in Schedule 1.

5. Information, the general nature of which is specified in Schedule 2 is prescribed as information required to be provided for the purposes of surveys of undertakings to which this Order applies.

6. Information referred to in Article 4 shall be provided by the undertaking concerned on an annual basis, as requested by the Director General of the Central Statistics Office.

7. (1) Subject to paragraph (2), an undertaking required by virtue of this Order to provide information to the Central Statistics Office shall provide such information by the completion of forms and questionnaires prepared by the Director General of the Central Statistics Office in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

(2) An undertaking required by virtue of this Order to provide information shall be deemed to comply with that obligation where Director General of the Central Statistics Office-

(a) consents to the information concerned being furnished by electronic means, and

(b) approves the format or manner in which that information is so furnished,

and that information is so furnished by the undertaking.

SCHEDULE 1 ACTIVITIES

Mining and quarrying

1. Mining and quarrying activities, including the extraction of minerals occurring naturally as solids (coals and ores), liquids (petroleum) or gases (natural gas). Extraction can be underground or surface mining or well operation.

Manufacturing

2. Manufacturing activities, namely, the mechanical, physical or chemical transformation of materials, substances or components into new products. The materials, substances or components transformed are raw materials that are products of agriculture, forestry, fishing, mining or quarrying as well as products of other manufacturing activities. Manufacturing also includes the renovation and reconstruction of goods and the specialised maintenance and repair of industrial commercial and similar machinery and equipment.

Electricity, gas, steam, air conditioning and water supply

3. Activities of the supply of electricity, gas, steam, air conditioning or water, including the activity of providing electric power, natural gas, steam supply, air conditioning and water supply through a permanent infrastructure (network) of lines, mains, and pipes. The size of network is not decisive; also included is electricity, gas, steam and water supply and the like in industrial parks or blocks of flats.

Sewage, waste management and remedial activities.

4. Activities relating to sewage, waste management and related remedial activities, including the collection and treatment of household and industrial waste, not for use in an industrial manufacturing process, but with the aim of disposal and resulting in a product of little or no value.

Information and communication.

5. Information and communication activities, including the production and distribution of information and cultural products, the provision of the means to transmit or distribute these products, as well as data or communications, information technology activities and the processing of data and other information service activities.

SCHEDULE 2 GENERAL NATURE OF INFORMATION TO BE PROVIDED

1. Particulars of the undertaking covered in the return.

2. Particulars of the value of turnover invoiced during the year by the undertaking.

3. Particulars of the value of operating subsidies received during the year by the undertaking.

4. Particulars of the value of purchases during the year by the undertaking.

5. Particulars of the value of indirect taxes which fall due for payment during the year by the undertaking.

6. Particulars of the value of fixed capital assets acquired and disposed of by the undertaking during the year.

7. Particulars of the value of stocks and work in progress of the undertaking at the beginning and end of the period concerned.

8. Particulars of the number of persons engaged in the undertaking on a specified reference week during the year.

9. Particulars of the value of gross earnings paid to employees during the year by the undertaking.

10. Particulars of the value of other labour costs incurred during the year by the undertaking.

11. E-commerce details relating to the undertaking.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be legal interpretation)

The Census of Industrial Production comprises of two separate but closely related annual inquiries, namely:

(i)the Census of Industrial Enterprises (required under EC Directive), which covers those enterprises which are wholly or primarily engaged in industrial production and have three or more persons engaged.

(ii)the Census of Industrial Local Units which covers all industrial local units with three or more persons engaged.

Following collection of the data, provisional overall results are released covering turnover, wages and salaries, gross value added and persons engaged. A detailed report follows, covering in more detail the aforementioned variables by various classifications namely, by manufacturing sector (NACE), nationality of ownership, county and regional authority etc. Manufacturing industries are classified using the General Industrial Classification of Economic Activities in the European Community (NACE).

Some industrial enterprises will be reclassified under services from 2009 and are included in the order for administrative purposes.
