SEA POLLUTION (PREVENTION OF POLLUTION BY SEWAGE FROM SHIPS) (AMENDMENT) REGULATIONS 2008 | ||

I, NOEL DEMPSEY, Minister for Transport, in exercise of the powers conferred on me by sections 10, 12, 14, 15 and 17 of the Sea Pollution Act 1991 (No. 27 of 1991) and the Maritime Transport, Safety and Security (Transfer of Departmental Administration and Ministerial Functions) Order 2005 ( S.I. No. 842 of 2005 ) hereby make the following regulations: | ||
1. (1) These Regulations may be cited as the Sea Pollution (Prevention of Pollution by Sewage from Ships) (Amendment) Regulations 2008. | ||
(2) These Regulations shall come into operation on 1 December 2008. | ||
2. Regulation 4(1)(a) of the Sea Pollution (Prevention of Pollution by Sewage from Ships) Regulations 2006 ( S.I. No. 269 of 2006 ) is amended by substituting for “holding tank” the following: | ||
“holding tank, or sewage originating from spaces containing living animals,”. | ||

EXPLANATORY NOTE | ||

These Regulations give effect to further provisions of Annex IV of the International Convention for the Prevention of Pollution from Ships, adopted by the International Maritime Organisation on 2 November, 1973 and as amended by its Protocol adopted on 17 February, 1978, and as further amended by the Marine Environment Protection Committee (MEPC) of the International Maritime Organisation under Resolutions recently adopted. | ||
These Regulations provide for control of sewage originating from spaces on ships containing living animals and for inspection and control of non-Irish MARPOL Annex IV ships in Irish ports which do not have adequate sewage regulation facilities or practice. | ||
Section 29 of the Sea Pollution Act, 1991 provides for penalties for breaches of these Regulations. |
