S.I. No. 909/2005 - Statistics(Business Registers) Order 2006


I, TOM KITT, Minister of State at the Department of the Taoiseach, in exercise of the powers conferred on me by section 25 (1) of the Statistics Act 1993 (No. 21 of 1993), and the Statistics (Delegation of Ministerial Functions) Order 2004 ( S.I. No. 664 of 2004 ), hereby order as follows:

1. (1)  This Order may be cited as the Statistics (Business Registers) Order 2006.

(2)    This Order comes into operation on 1 January 2006 and expires on 31 December 2010.

2.  In this Order “non-resident” means any person other than -

(a)  a person who has been residing in the State for a period of not less than 1 year or who is residing in the State and intends to continue residing in the State for a period of not less than 1 year,

(b)  a person whose registered office is in the State, or

(c)  a person who has a place of business in the State and who carries on business at that place.

3.   This Order applies to all undertakings which are, at any time during a year in which a survey referred to in Article 4 is undertaken, engaged in an economic activity classified for statistical purposes under any of the sections of NACE Rev. 1.1 set out in the Annex to Council Regulation (EEC) No. 29/2002 of 19 December 20011 .

4.   Information, the general nature of which is specified in the Schedule to this Order is prescribed as information required to be provided for the purposes of surveys of undertakings to which this Order applies undertaken by the Central Statistics Office at intervals of not more than 12 months (the first of which shall be undertaken in the year 2006).

5.    An undertaking to which this Order applies is prescribed as an undertaking required to provide the Central Statistics Office with information relating to its economic activities and structure, the general nature of which information is specified in the Schedule to this Order.

6.   (1)  Subject to paragraph (2) of this Article, undertakings required by virtue of this Order to provide information to the Central Statistics Office shall provide such information by the completion of forms and questionnaires prepared by the Director General of the Central Statistics Office in accordance with section 23 of the Statistics Act 1993 (No. 21 of 1993).

(2)  An undertaking required by virtue of this Order to furnish information shall be deemed to comply with that obligation where, with the consent of the Director General of the Central Statistics Office, the information is furnished by electronic means, and provided that the Director General approves the format or manner in which the information is provided.

SCHEDULE

1.   Particulars of the legal name, trading names and other aliases by which the undertaking is known.

2.   General description of the business activity carried on by the undertaking.

3.   Particulars of the main categories of goods and services dealt in by the undertaking.

4.   Particulars of the turnover of the undertaking and of the accounting year to which those particulars relate.

5.   Particulars of any business transactions with any non-resident.

6.   Particulars of shareholdings in, or ownership of the undertaking (including particulars of shareholdings in or ownership of the undertaking by a non-resident).

7.   Particulars of shareholdings, or ownership of any other undertaking (including undertakings located overseas) by the undertaking being surveyed.

8.   Particulars of the number of and employment status of persons engaged in the undertaking.

9.   Particulars of the number of outlets, branches and subsidiaries attached to the undertaking in the State.

10. Particulars of the legal status of the undertaking.

11. Particulars of the year and month of commencement of the business.

12. Particulars of the structure of the undertaking.
