SOCIAL WELFARE (CONSOLIDATED SUPPLEMENTARY WELFARE ALLOWANCE) (AMENDMENT) (No. 1) REGULATIONS 2005.

The Minister for Social and Family Affairs, in exercise of the powers conferred on him by sections 4 (as amended by section 26 of the Social Welfare and Pensions Act 2005 (No. 4 of 2005) and 179 (as amended by section 13 of the Social Welfare (Miscellaneous Provisions) Act 2003 (No. 4 of 2003)) of the Social Welfare (Consolidation) Act 1993 (No. 27 of 1993) hereby makes the following Regulations:

Citation and construction

1.  (1)  These Regulations may be cited as the Social Welfare (Consolidated Supplementary Welfare Allowance (Amendment) (No. 1) Regulations 2005.

(2)  These Regulations and the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 1995 ( S.I. No. 382 of 1995 ) shall be construed together as one and may be cited as the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 1995 to 2005.

Commencement

2.  These Regulations come into operation on 25 July 2005.

Definitions

3.  In these Regulations:

“the Principal Regulations” means the Social Welfare (Consolidated Supplementary Welfare Allowance) Regulations 1995 ( S.I. No. 382 of 1995 ); and

“the Regulations of 2003” means the Social Welfare (Consolidated Supplementary Welfare Allowance (Amendment) (No. 3) Regulations 2003 ( S.I. No. 727 of 2003 ).

Maximum amount of rent in respect of which a supplement is payable

4.  The Principal Regulations are amended by:

(a)  the substitution in sub-article 9(2) of paragraph (g (as amended by article 3 of the Regulations of 2003) for “for the period commencing on 1 January 2004 and ending on 30 June 2005” of “for the period commencing on 25 July 2005 and ending on 31 December 2006”,

(b)  the substitution in article 13 (as amended by article 4 of the Social Welfare (Consolidated Supplementary Welfare Allowance) (Amendment (No. 2) Regulations 2002 ( S.I. No. 630 of 2002 ) for “EUR 45” of “EUR 55” and for “EUR 40” of “EUR 50”, and

(c)  the substitution for Schedule C (as amended by article 3 of the Regulations of 2003) of the following:

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These regulations provide for the continuation until 31 December 2006 of the levels of maximum rent, as set out in Schedule C, in respect of which Rent Supplement is paid. The Health Service Executive may, in respect of sub-divisions of its functional areas set levels below that provided for in these regulations.

In addition, these regulations also provide for an increase in the maximum amount of Rent Supplement payable to tenants in voluntary housing developments funded through the local authority Capital Assistance Scheme. The maximum amounts are being increased to €50.00 (from €40.00) for a single person and to €55.00 (from €45.00) for couples.
