S.I. No. 402/2003 - European Communities (Control of Major Accident Hazards Involving Dangerous Substances) (Amendment) Regulations 2003


I, Mary Harney, Minister for Enterprise, Trade and Employment in exercise of the powers conferred on me by section 3 of the European Communities Act 1972 (No. 27 of 1972) and for the purpose of giving further effect to Council Directive 96/82/EC of 9 December 19961 , hereby make the following regulations:

1. These Regulations may be cited as the European Communities (Control of Major Accident Hazards Involving Dangerous Substances) (Amendment) Regulations 2003.

2. Regulation 17 of the European Communities (Control of Major Accident Hazards Involving Dangerous Substances) Regulations 2000 ( S.I. No. 476 of 2000 ) is amended by substituting the following for paragraph (2)(e) -

“(e) the public.”.

Explanatory Note

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations amend Regulation 17(2)(e) of the European Communities (Control of Major Accident Hazards Involving Dangerous Substances) Regulations 2000 ( S.I. No. 476 of 2000 ).

The Regulations are intended to ensure that the public is consulted on external emergency plans as provided for in Article 11.3 of Council Directive 96/82/EC of 9th December, 1996 on the control of major accident hazards involving dangerous substances.
