I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive 86/363/EEC of 24 July 19861 , Council Directive 93/57/EEC of 29 June 19932 , Council Directive 94/29/EC of 23 June 19943 , Council Directive 95/39/EC of 17 July 19954 and the corrigenda to Council Directive 95/39/EC5 , Council Directive 96/33/EC of 21 May 19966 , Council Directive 97/41/EC of 25 June 19977 , Commission Directive 97/71/EC of 15 December 19978 , Commission Directive 98/82/EC of 27 October 19989 , Commission Directive 1999/71/EC of 14 July 199910 , Commission Directive 2000/24/EC of 28 April 200011 , Commission Directive 2000/58/EC of 22 September 200012 , Commission Directive 2000/42/EC of 22 June 200013 and the corrigenda to Commission Directive 2000/42/EC of 22 June 200014 , Commission Directive 2000/81/EC of 18 December 200015 and Commission Directive 2000/82/EC of 20 December 200016 , Commission Directive 2001/39/EC of 23 May 200117 and Commission Directive 2001/57/EC of 25 July 200118 , hereby make the following Regulations:

1. (1)  These Regulations may be cited as the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) (Amendment) (No. 3) Regulations, 2001.

(2)  These Regulations shall come into operation on the 1st day of January 2002.

2.      In these Regulations -

“the Principal Regulations” means the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) Regulations, 1999 ( S.I. No. 180 of 1999 ).

“the Directive” means Council Directive 86/363/EEC of 24 July 19861 , as amended by Council Directive 93/57/EEC of 29 June 19932 , Council Directive 94/29/EC of 23 June 19943 , Council Directive 95/39/EC of 17 July 19954 and the corrigenda to Council Directive 95/39/EC5 , Council Directive 96/33/EC of 21 May 19966 , Council Directive 97/41/EC of 25 June 19977 , Commission Directive 97/71/EC of 15 December 19978 , Commission Directive 98/82/EC of 27 October 19989 , Commission Directive 1999/71/EC of 14 July 199910 , Commission Directive 2000/24/EC of 28 April 200011 , Commission Directive 2000/58/EC of 22 September 200012 , Commission Directive 2000/42/EC of 22 June 200013 and the corrigenda to Commission Directive 2000/42/EC of 22 June 200014 , Commission Directive 2000/81/EC of 18 December 200015 , Commission Directive 2000/82/EC of 20 December 200016 , Commission Directive 2001/39/EC of 23 May 200117 and Commission Directive 2001/57/EC of 25 July 200118 .

3.      Annex II of the Principal Regulations is hereby amended by the replacement of the following entries to Part B of Annex II:

(p) Indicates provisional maximum residue level established in accordance with Article 4(1) (f) of Directive 91/414/EEC: all provisional maximum residue levels for these pesticide residues will be treated as definitive in accordance with Article 10 of the Directive with effect from 2 June 2005.
