S.I. No. 553/2001 - European Communities (Processed Animal Products) (Amendment) Regulations, 2001
I, Joe Walsh, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No 27 of 1972), for the purposes of giving effect to Commission Decision 2001/165/EC of 27 February, 20011 , and for the purposes of giving further effect to Council Decision 2000/766/EC of 4 December 20002 and Commission Decision 2001/9 of 29 December, 20003 , hereby make the following Regulations: | ||||||
1. (1) These Regulations may be cited as the European Communities (Processed Animal Products) (Amendment) Regulations, 2001. | ||||||
(2) The European Communities (Processed Animal Products) Regulations, 2000 and these Regulations may be cited collectively as the European Communities (Processed Animal Products) Regulations, 2000 to 2001. | ||||||
2. (1) Regulation 2(1) of the European Communities (Processed Animal Products) Regulations, 2000 is hereby amended by the substitution, for the definition of “the Commission Decision”, of the following definition:- | ||||||
“the Commission Decision” means Commission Decision 2001/9/EC of 29 December, 2000 providing for control measures required for the implementation of Council Decision 2000/766/EC concerning certain protection measures with regard to transmissible spongiform encephalopathies and the feeding of animal protein, as amended by Commission Decision 2001/165/EC of 27 February, 2001.” | ||||||
(2) Regulation 2(1) of the European Communities (Processed Animal Products) Regulations, 2000 is hereby amended by the insertion of the following definition:- | ||||||
“For the purposes of these Regulations, farm means all lands or premises owned or operated by a natural or legal person on which farmed animals are kept.” | ||||||
(3) Regulation 6 of the European Communities (Processed Animal Products) Regulations, 2000 is hereby amended by the substitution for paragraph (1) of the following:- | ||||||
“A person shall not:- | ||||||
(a) have processed animal proteins, in their possession or under their control on any land, premises or farm | ||||||
(i) used for or in connection with the manufacture of feedingstuffs, or | ||||||
(ii) used for or in connection with the holding, handling, keeping or farming of any farmed animals, or | ||||||
(b)incorporate processed animal proteins into any feedingtuffs intended for feeding to animals other than ruminants except in accordance with a licence granted by the Minister under Regulation 7.” | ||||||

These Regulations amend the European Communities (Processed Animal Products) Regulations, 2000 so as to give effect to Commission Decision 2001/165/EC. They also clarify certain provisions in the original Regulations in relation to eligibility for a licence. | ||||||
