S.I. No. 540/2001 - Waste Management (Collection Permit) (Amendment) Regulations, 2001


The Minister for the Environment and Local Government, in exercise of the powers conferred on him by sections 7 and 34 of the Waste Management Act, 1996 (No. 10 of 1996), hereby makes the following Regulations:-

1.       These Regulations may be cited as the Waste Management (Collection Permit) (Amendment) Regulations, 2001.

2.       The Waste Management (Collection Permit) Regulations, 2001 ( S.I. No. 402 of 2001 ) are hereby amended by -

(a)      the substitution of the following article for article 4 -

“4.     (a)     Subject to paragraph (b), the 30th day of November 2001 is hereby prescribed for the purposes of section 34(1)(a) of the Act.

(b)     The 30th day of June 2002 is hereby prescribed for the purposes of section 34(1)(a) of the Act, in respect of the collection of faecal matter of animal origin in the form of slurry, and residual sludge from septic tanks.”;

(b)      the substitution of the following article for article 27 -

“27.    It is hereby prescribed that the register established and maintained by a local authority in accordance with section 19 of the Act shall contain entries specifying the receipt of any notification under article 26(2) and the name and address of the broker or dealer concerned.”.

EXPLANATORY NOTE

(This note is not part of the Instrument and does not purport to be a legal interpretation).

These Regulations amend the Waste Management (Collection Permit) Regulations, 2001 ( S.I. No. 402 of 2001 ), to the effect that 30 June 2002 is the prescribed date for the application of the waste collection permit system provided for under section 34 of the Waste Management Act, 1996 in respect of the collection of animal and poultry slurries and septic tank sludge.
