S.I. No. 17/2001 - European Communities (Minimum Measures For The Control of Certain Diseases Affecting Bivalve Molluscs) (Amendment) Regulations, 2001


I, Frank Fahey, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 , ( No. 27 of 1972 ), and for the purpose of giving further effect to Council Directive 95/70/EC of 22 December 19951 , hereby make the following regulations:

1.       These Regulations may be cited as the European Communities (Minimum measures for the control of certain diseases affecting bivalve molluscs) (Amendment) Regulations, 2001.

2.       The European Communities (Minimum measures for the control of certain disease affecting bivalve molluscs) Regulations, 1999 ( S.I. No. 26 of 1999 ), is amended by the substitution for Regulation 13 of the following Regulation:

“13.     (1)       The Fisheries Research Centre of the Marine Institute is designated, for the purposes of these Regulations and the Council Directive, as the national reference laboratory.

(2)       Sampling and laboratory testing for the determination of the cause of abnormal mortality of bivalve molluscs shall be carried out by the national reference laboratory using the methods established in accordance with the procedures laid down in Article 10 of the Council Directive.”

This Regulation amends the European Communities (Measures for the control of certain diseases affecting bivalve molluscs) Regulations 1999 ( S.I. No. 26 of 1999 ) to delineate the duties of the national reference laboratory with reference to Council Directive 95/70/EC of 22 December 1995.
