S.I. No. 492/2000 - Plant Varieties (Proprietary Rights) (Amendment) Act, 1998 (Form of Certificate of Plant Breeders' Rights) Regulations, 2000.


I, JOE WALSH, Minister for Agriculture, Food and Rural Development, in exercise of the powers conferred on me by section 15 (2) and (7) of the Plant Varieties (Proprietary Rights) (Amendment) Act, 1998 (No. 41 of 1998) (as adapted by the Agriculture and Food (Alteration of Name of Department and Title of Minister) Order 1999 ( S.I. No. 307 of 1999 )) hereby make the following regulations:

1. These Regulations may be cited as the Plant Varieties (Proprietary Rights) (Amendment) Act, 1998 (Form of Certificate of Plant Breeders' Rights) Regulations, 2000.

2. It is hereby prescribed that the certificate referred to in section 15 (2)(a) of the Plant Varieties (Proprietary Rights) (Amendment) Act, 1998 (No. 41 of 1998), shall be in the form set out in the Schedule to these Regulations.

3. The Plant Breeders' Rights (Form of Certificate) Regulations, 1982 ( S.I. No. 19 of 1982 ), are revoked.

CERTIFICATE OF PLANT BREEDERS' RIGHTS

WHEREAS the Controller of Plant Breeders' Rights has granted plant breeders' rights to _________________________, of _______________________, on _________, in respect of the variety of plant genus or species specified in the Schedule hereto.

NOW, the said Controller hereby issues under section 15 (2) of the Plant Varieties (Proprietary Rights) (Amendment) Act, 1998 (No. 41 of 1998), this certificate in respect of that variety, which may be exercisable during the period of ____________ years from the date of issue of this certificate.
