EUROPEAN COMMUNITIES (EXPORT AND IMPORT OF CERTAIN DANGEROUS CHEMICALS) (PESTICIDES) (ENFORCEMENT) (AMENDMENT) REGULATIONS, 1998

I, Joe Walsh, Minister for Agriculture and Food, in exercise of the powers conferred on me by
section 3
of the
European Communities Act, 1972
(No. 27 of 1972), and for the purpose of giving effect to Council Regulation (EEC) No 2455/92 of 23 July 1992 1, as amended by Council Regulation (EEC) No 3135/94 of 15 December 1994 2, Commission Regulation (EC) No 1492/96 of 26 July 3 and Commission Regulation (EC) No 1237/97 of 27 June 1997 4, hereby make the following Regulations:

1 Citation and Commencement
|
1. (1) These Regulations may be cited as the European Communities (Export and Import of Certain Dangerous Chemicals) (Pesticides) (Enforcement) (Amendment) Regulations, 1998.
|
| |
(2) These Regulations shall come into operation on the first day of May, 1998.
|
| |
(3) The European Communities (Export and Import of Certain Dangerous Chemicals) (Pesticides) (Enforcement) Regulations, 1995, the European Communities (Export and Import of Certain Dangerous Chemicals) (Pesticides) (Enforcement) (Amendment) Regulations, 1995, and these Regulations may be cited together as the European Communities (Export and Import of Certain Dangerous Chemicals) (Pesticides) (Enforcement) Regulations, 1995 to 1998 and shall be construed together as one.

2 Interpretation
|
2. (1) In these Regulations "the Principal Regulations" means the European Communities (Export and Import of Certain Dangerous Chemicals) (Pesticides) (Enforcement) Regulations, 1995 (
S.I. No. 135 of 1995
).

(2) The phrase "designated chemist" and the interpretation of the phrase that follows it, included in the paragraph (1) of Regulation (2) of the Principal Regulations, is hereby replaced by the following:
|
| |
" "designated analyst" means any appropriately qualified officer of the Minister who is authorized in writing by the Minister for the purposes of these Regulations."
|
| |
(3) The phrase "the State Chemist" and the interpretation of the phrase that follows it, included in the paragraph (1) of Regulation (2) of the Principal Regulations, is hereby replaced by the following:
|
| |
" "the State Chemist" means the Head of the State Laboratory or a member of the staff of the State Laboratory authorized by the State Chemist in writing to perform functions assigned to the State Chemist in accordance with Regulation 9."
|
| |
(4) A word or expression that is used in any Council Directive or Regulation or in any Commission Directive or Regulation of the European Communities mentioned in these Regulations has, until the contrary intention appears, the meaning in these Regulations that it has in the Directive or Regulation concerned.
|
|
3 Amendments
|
3. (1) Annex II as set out in First Schedule of the Principal Regulations is hereby revoked and replaced by Annex II as set out in the Schedule to these regulations.

(2) Annex III as set out in First Schedule of the Principal Regulations is hereby revoked and replaced by Annex III as set out in the Schedule to these regulations

The information contained in this Annex is based on the PIC Circular VI - July 1996 and on the Update of PIC Circular VI - January 1997
|
| |
1. List of chemicals subject to the international PIC procedure
|
| |
The following chemicals have been introduced in the PIC procedure following control actions reported by participating countries. For aldrin, dieldrin, DDT, dinoseb & dinoseb salts, fluoroacetamide, HCH, chlordane, chlordimeform, EDB, heptachlor, mercury compounds, reported control actions refer to pesticide use (as defined by the FAO/UNEP). For crocidolite, PBBs, PCBs, PCTs and tris(2,3 dibromopropyl) phosphate, reported control actions refer to industrial use. Decision Guidance Documents (DGDs) have been prepared by UNEP/FAO (IRPTC) to help countries to make import decisions concerning those chemicals. Nevertheless, the DGDs are not the only information taken into account by countries when they take their import decision. Therefore, the import decision does not necessarily refer to the uses mentioned in the DGDs.

EXPLANATORY NOTE
|
| |
These Regulations serve to implement the provisions of Council Regulation (EC) No 1492/96 and Commission Regulation (EC) No 1237/97 which update the lists of participating countries and the import decisions made by them contained in Council Regulation (EEC) No 2455/92. Revised forms to be completed by exporters proposing to export chemicals which have been banned or severely restricted owing to their effects on health and the environment, are specified.
