EUROPEAN COMMUNITIES (PESTICIDE RESIDUES) (FOODSTUFFS OF ANIMAL ORIGIN) (AMENDMENT) REGULATIONS, 1998. | ||
I, JOE WALSH, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Commission Directive 97/71/EC of 15 December, 19971, hereby make the following Regulations: | ||
1O.J. No. L347/42 18/12/1997. 1. (1) These Regulations may be cited as the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) (Amendment) Regulations, 1998 and shall come into operation on the 1st day of April 1998. | ||
(2) The European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) Regulations, 1988 to 1996 and these Regulations may be cited as the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) Regulations, 1988 to 1998 and shall be construed together as one. 2. In these Regulations— | ||
"the Principal Regulations" means the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) Regulations, 1988 ( S.I. No. 217 of 1988 ); | ||
"the Regulations of 1993" means the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) (Amendment) Regulations, 1993 ( S.I. No. 317 of 1993 ); | ||
"the Regulations of 1995" means the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) (Amendment) Regulations, 1995 ( S.I. No. 165 of 1995 ); | ||
"the Regulations of 1996" means the European Communities (Pesticide Residues) (Foodstuffs of Animal Origin) (Amendment) (No. 2) Regulations, 1996 ( S.I. No. 412 of 1996 ); 3. The footnotes to Annex II Part A of the Schedule to the Principal Regulations (as inserted by Regulation 3(2) of the Regulations of 1993) are hereby replaced by the following: | ||
"(a) Should levels not be adopted by 31 October 1998, the following maximum level shall apply: 0.05*" 4. The footnotes to Annex II Part B of the Schedule to the Principal Regulations (as inserted by Regulation 3(b) of the Regulations of 1995) are hereby replaced by the following: | ||
"(a) As from at the latest 1 July 2000 and save for adoption of other levels, the following maximum limit shall apply: 0.02" 5. The Schedule to the Principal Regulations is hereby amended: | ||
(a) by the substitution of the following footnote to Annex II Part A (as inserted by Regulation 3(b) of the Regulations of 1996): | ||
"(a) Should levels not be adopted by at the latest 1 July 2000, the following maximum levels shall apply: | ||
(a) 0.05* | ||
(b) 0.01*" | ||
and | ||
(b) by the substitution of the following footnote to Annex II Part B (as inserted by Regulation 3(d) of the Regulations of 1996): | ||
"(a) Should a maximum level not be adopted by at the latest 1 July 2000, a maximum level of 0.05* shall apply." | ||

EXPLANATORY NOTE. | ||
The Regulations amend existing Regulations fixing maximum residue limits (MRLs) for foodstuffs of animal origin by extending the dates by which the open positions would be replaced with definite MRLs. |
