HARBOURS ACT, 1996 (COMMENCEMENT) (NO. 3) ORDER, 1997

I, Michael Woods, Minister for the Marine and Natural Resources, in exercise of the powers conferred on me by section 1 (2) of the Harbours Act, 1996 (No. 11 of 1996), as adapted by the Marine (Alteration of Name of Department and Title of Minister) Order, 1997 ( S.I. No. 301 of 1997 ), hereby order as follows:

1. This Order may be cited as the Harbours Act, 1996 (Commencement) (No. 3) Order, 1997.

2. The 26th day of July, 1997, is hereby fixed as the day on which the following provisions of the Harbours Act, 1996 (No. 11 of 1996), shall come into operation (other than in relation to Arklow Harbour Company, Dundalk Port Company, Port of Waterford Company and Wicklow Port Company), namely—

( a ) Section 5(2) in so far as it relates to the Pilotage Act, 1913, and the Pilotage (Amendment) Act, 1962 ;

( b ) so much of Part IV as is not in operation immediately before the making of this Order;

( c ) section 83(2);

( d ) section 84 in so far as it relates to section 71; and

( e ) section 105.

EXPLANATORY NOTE

This Order fixes the 26th day of July, 1997 as the day on which certain pilotage provisions of the Harbours Act, 1996 come into operation in relation to companies other than Arklow Harbour Company, Dundalk Port Company, Port of Waterford Company and Wicklow Port Company.
