VOCATIONAL EDUCATION COMMITTEES (FILLING OF CASUAL VACANCIES) REGULATIONS, 1996.

I, NIAMH BHREATHNACH, Minister for Education, in exercise of the powers conferred on me by Section 19 (4) of the Local Government (Dublin) Act, 1993 (No. 31 of 1993), hereby make the following Regulations:

1. These Regulations may be cited as the Vocational Education Committees (Filling of Casual Vacancies) Regulations, 1996.

2. In these Regulations—

"casual vacancy" means a vacancy which occurs in the membership of a vocational education committee by reason of the death, resignation, or disqualification of a member thereof;

"vocational education committee" means the County Dublin Vocational Education Committee or the Dún Laoghaire Vocational Education Committee.

3. If a casual vacancy occurs before the elections of councils of counties next after the commencement of these Regulations, the vocational education committee concerned shall, following consultations with the Minister for Education, select a person to fill the vacancy and, upon selection, the person shall become and be a member of that vocational education committee.

4. In selecting a member to fill a casual vacancy, a vocational education committee shall:

( a ) have regard to the provisions relating to the composition of such committees set out in section 8 (3) of the Vocational Education Act 1930 , and

( b ) ensure that, as far as practicable, the person selected has an interest and experience in education similar to that of the member he or she is replacing, and

( c ) if the member whose death, resignation or disqualification occasioned the vacancy was originally recommended under section 8 (4) of that Act by any particular body, that body or its successor shall recommend to the vocational education committee one person to fill the vacancy who shall, subject to paragraph (b) of this Regulation, be so selected.
