MINERALS DEVELOPMENT (AMENDMENT) REGULATIONS, 1995.

I, MICHAEL LOWRY, Minister for Transport, Energy and Communications, in exercise of the powers conferred on me by section 80 of the Minerals Development Act, 1940 (No. 31 of 1940), and the Energy (Transfer of Departmental Administration and Ministerial Functions) (No. 2) Order, 1993 ( S.I. No. 12 of 1993 ) (as adapted by the Energy (Alteration of Name of Department and Title of Minister) Order, 1993 ( S.I. No. 16 of 1993 ) ), hereby make the following Regulations:

1. These Regulations may be cited as the Minerals Development (Amendment) Regulations, 1995, and shall come into operation on the 1st day of September, 1995.

2. These Regulations and the Minerals Development Regulations, 1979 and 1994, may be cited together as the Minerals Development Regulations, 1979 to 1995, and shall be construed together as one.

3. An application under section 9 of the Minerals Development Act, 1940 (No. 31 of 1940), for a prospecting licence in respect of gypsum on or under the townlands specified in the First Schedule to these Regulations shall be made, not later than 5 p.m. on the 31st day of October, 1995, to the Minister for Transport, Energy and Communications in accordance with the Form set out in the Second Schedule to these Regulations and shall not be made in accordance with Form No. 1 set out in the First Schedule to the Minerals Development Regulations, 1979 ( S.I. No. 340 of 1979 ) (as amended by the Minerals Development (Amendment) Regulations, 1994 ( S.I. No. 319 of 1994 )).

In the case of a company that is not the holder of a current Prospecting Licence, the application must be accompanied by copies of its most recent Annual Report and audited accounts, together with information concerning its share capital and details of significant shareholdings.

(7) ( a ) A full and detailed description of the programme of prospecting/development which the applicant proposes to carry out for the area applied for, including particulars of any special techniques or equipment to be used (use additional pages if required to give comprehensive details).

( b ) Estimates, for each year of the Prospecting Licence, of the proposed expenditure on each category of activity comprising the programme for the area applied for.

(8) Information concerning the applicant's previous experience in prospecting for minerals or developing mineral deposits (if not previously the holder of a Prospecting Licence).

(9) Names, addresses, qualifications and experience of technical experts or advisers who will organise and carry out the programme. If the applicant will be the operator, then this should be stated.

EXPLANATORY NOTE.

These Regulations specify a particular Application Form to be used by applicants in a special competition for a prospecting licence in respect of gypsum on or under certain townlands in County Cavan. The closing date of the competition is 31 October, 1995 (5 p.m.).
