EUROPEAN COMMUNITIES (AWARD OF PUBLIC WORKS CONTRACTS) (AMENDMENT) REGULATIONS, 1994.

WHEREAS Council Directive No. 93/37/EEC of 14 June 19931, consolidates with amendments the provisions of Council Directive No. 71/305/EEC of 26 December 19712, as amended;

Now I, BERTIE AHERN, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 93/37/EEC of 14 June 19931, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Award of Public Supply Contracts) (Amendment) Regulations, 1994.

2. (1) In these Regulations "the Council Directive" means Council Directive No. 93/37/EEC of 14 June 19931.

(2) A word or expression that is used in these Regulations and is also used in the Council Directive has, unless the contrary intention appears, the same meaning in these Regulations as it has in the Council Directive.

3. Any reference in the European Communities (Award of Public Supply Contracts) Regulations, 1992 ( S.I. No. 36 of 1992 ), or in any other enactment to Council Directive No. 77/305/EEC of 26 December 19712, or to any provision thereof shall be construed as a reference to the Council Directive or to the corresponding provision thereof in accordance with the correlation table set out in Annex VIII to the Council Directive.

EXPLANATORY NOTE.

These Regulations relate to the EEC Council Directive which governs the procedures for the procurement of works (both building and civil engineering) by public bodies. In addition where contracting authorities must comply or ensure compliance when they subsidise directly by more than 50% a works contract awarded by an entity other than themselves. In general, the procedures must be followed when contract value exceeds the relevant thresholds in the Directive.
