NURSING HOMES (CARE AND WELFARE) (AMENDMENT) REGULATIONS, 1993.

The Minister for Health, in exercise of the powers conferred on him by Section 6 of the Health (Nursing Homes) Act, 1990 (No. 23 of 1990) hereby makes the following Regulations:—

1. These Regulations may be cited as the Nursing Homes (Care and Welfare) (Amendment) Regulations, 1993.

2. Article 4 of the Nursing Homes (Care and Welfare) Regulations, 1993 ( S.I. No. 226 of 1993 ) is hereby amended by the deletion of the definitions of "competent person" and "medical record" and the substitution therefor of:—

' "competent person" means

(i) a chartered engineer, or

(ii) a properly and suitably qualified architect

with experience in fire safety design and management', and

' "medical record" means a record under article 19.1 (e) of these Regulations'

3. Article 23.1 of the Nursing Homes (Care and Welfare) Regulations, 1993 is hereby amended by the deletion of paragraph (b) and the substitution therefor of:—

"( b ) subject to article 23.2, permit designated officers to examine records kept by the nursing home and to obtain copies of any such records or of extracts therefrom;"

EXPLANATORY NOTE.

These Regulations amend the Nursing Homes (Care and Welfare) Regulations, 1993 ( S.I. No. 226 of 1993 ) to broaden the definition of a competent person for the purposes of fire safety requirements under article 27 (e) and 27 (f) of the Regulations to include a properly and suitably qualified architect. The other amendments, concerning the definition of a medical record and article 23.1 (b), are for the purpose of correlating the appropriate reference numbers in the Regulations.
