INLAND POST AMENDMENT (No. 47) SCHEME, 1991

AN POST, in exercise of the powers conferred on it by Section 70 of the Postal and Telecommunications Services Act, 1983 (No. 24 of 1983), and with the consent of the Minister for Tourism, Transport and Communications, hereby makes the following Scheme:

1. (1) This Scheme may be cited as the Inland Post Amendment (No. 47) Scheme, 1991.

(2) This Scheme shall come into operation on the 2nd day of April, 1991.

2. In this Scheme—

"the Principal Warrant" means the Inland Post Warrant, 1939 ( S.I. No. 202 of 1939 ).

"Scheme No. 36" means the Inland Post Amendment (No. 36) Scheme, 1986 ( S.I. No. 362 of 1986 ).

"Scheme No. 44" means the Inland Post Amendment (No. 44) Scheme, 1989 ( S.I. No. 363 of 1989 ).

3. Regulation 3 (16) of the Principal Warrant is hereby amended by the substitution for that Regulation of the following:

"The expression inland when used in relation to any postal packet or any description thereof means posted within Ireland and addressed to some place in Ireland and Northern Ireland."

4. Regulation 5 of the Inland Post Amendment (No. 5) Warrant, 1953 (inserted by Regulation 12 of the Inland Post Amendment (No. 19) Warrant, 1974 ( S.I. No. 280 of 1974 ), as amended by Regulation 4 of Scheme No. 44, is hereby amended by the substitution for "forty pounds" of "one hundred pounds".

5. Regulation 3 (2) (ii) of the Inland Post Amendment (No. 30) Scheme, 1985 ( S.I. No. 396 of 1985 ), as amended by Regulation 5 of Scheme No. 44, is hereby amended by the substitution for "twenty five pounds" or "£25" of "fifty pounds" or "£50".

6. (a) Regulation 6 (b) of the Inland Post Amendment (No. 33) Scheme, 1985 ( S.I. No. 444 of 1985 ), as amended by Regulation 7 (a) of Scheme No. 44, is hereby amended by the substitution for "6p" of "10p".

(b) Regulation 8 (a) of Inland Post Amendment (No. 33) Scheme, 1985 ( S.I. No. 444 of 1985 ), as amended by Regulation 7 (b) of Scheme No. 44, is hereby amended by the substitution for "forty pounds" or "£40" of "one hundred pounds" or "£100".

7. Regulation 7 (a) of the Inland Post Amendment (No. 34) Scheme, 1985 ( S.I. No. 445 of 1985 ), as amended by Regulation 8 of Scheme No. 44, is hereby amended by the substitution for "forty pounds" of "one hundred pounds".

8. The First Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 9 of Scheme No. 44) of the entries in the First Schedule to this Scheme.

9. The Second Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 10 of Scheme No. 44) of the entries in the Second Schedule to this Scheme.

10. The Third Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 11 of Scheme No. 44) of the entries in the Third Schedule to this Scheme.

11. The Fourth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 12 of Scheme No. 44) of the entries in the Fourth Schedule to this Scheme.

12. The Fifth Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein (inserted by Regulation 13 of Scheme No, 44) of the entries in the Fifth Schedule to this Scheme.

13. The First Schedule to Scheme No. 36 is hereby amended by the substitution for the entries therein (inserted by Regulation 10 of Scheme No. 36) of the entries in Section 1 of the First Schedule to this Scheme. Volume related discounts on the rates therein will be allowed for Direct Mail purposes under Scheme No. 36.

14. The Seventh Schedule to the Principal Warrant is hereby amended by the substitution for the entries therein inserted by Regulation 6 of the Inland Post Amendment (No. 42) Scheme, 1989 ( S.I. No. 86 of 1989 ) of the entries in the Sixth Schedule to this Scheme.

15. The First Schedule to the Inland Post Amendment (No. 31) Scheme, 1985 ( S.I. No. 94 of 1985 ), inserted by Regulation 14 of Scheme No. 44, is hereby amended by the substitution for the entries therein of the entries in Section 9 of the First Schedule to this Scheme.

16. The Schedule to the Inland Post Amendment (No. 35) Scheme, 1986 ( S.I. No. 89 of 1986 ), is hereby amended by the substitution for the entries therein (inserted by Regulation 6 (1) of the Inland Post Amendment (No. 35) Scheme, 1986 ( S.I. No. 35 of 1986 )) of the entries in the Seventh Schedule to this Scheme.

(3) Any periodical will, if posted or tendered for transmission by post by a member of the public, be charged with postage as a printed paper.

1. Late Fee Postal Packet

For delivery in Ireland a minimum charge of £2.00 within the state only plus at the rate of 75p for each 1 km or part thereof. These charges also include express delivery items sent for delivery to Northern Ireland.

If collected by motor cycle £6.25. If collected by other means of conveyance £12 plus £1 per kg in excess of 2 kg whichever is the greater plus waiting time at £1 per 15 minutes.

Fragile, bulky or heavy items will not be carried by motor cycle. If the address of the addressee is not in the Republic of Ireland an adhesive customs declaration form in a format approved by An Post plus three copies of a commercial invoice must accompany each courier postal packet.

Plus a conveyance and delivery charge of £9.25 for packets of 1 kg or less, £11.25 for packets of 1 to 5 kg and £1 per additional kg if the point of delivery and collection are in different cities or towns within the State. If the point of delivery is outside the State a conveyance and delivery charge of £40 plus £1.50 for every kg in excess of 5 kg.

EXPLANATORY NOTE

This Scheme applies to the Inland Post Service and comes into operation on the 2nd day of April, 1991. It authorises increases in the letter, postcard, printed packet, newspaper, sample packet and parcel post rates of postage and in the fees charged for the express delivery, registration, customs clearance, cash-on-delivery, Business Reply, Freepost, Publicity Post, Postaim, Same Day Service, Parcel Sure-Service, Parcel Forward and other miscellaneous services.
