LOCAL GOVERNMENT (PLANNING AND DEVELOPMENT) (FEES) (AMENDMENT) REGULATIONS, 1991.

The Minister for the Environment, in exercise of the powers conferred on him by section 10 of the Local Government (Planning and Development) Act, 1963 (No. 28 of 1963) and by section 10 of the Local Government (Planning and Development) Act, 1982 (No. 21 of 1982), and with the consent of the Minister for Finance, hereby makes the following Regulations:—

1 Citation.

1. (1) These Regulations may be cited as the Local Government (Planning and Development) (Fees) (Amendment) Regulations, 1991.

(2) These Regulations and the Local Government (Planning and Development) Regulations, 1977 to 1990 may be cited together as the Local Government (Planning and Development) Regulations, 1977 to 1991.

2 Commencement.

2. These Regulations shall come into operation on the 15th day of July, 1991.

3 Amendment of First Schedule of 1984 Regulations.

3. The Local Government (Planning and Development) (Fees) Regulations, 1984 ( S.I. No. 358 of 1984 ) are hereby amended by the insertion between class 3 and class 4 in columns 1 and 2 of Section II of the First Schedule of the following matter—

"3A
(a) Use of uncultivated land or semi-natural areas for intensive agricultural purposes, where the area involved would be greater than 100 hectares.	£150
(b) Initial afforestation, where the area involved would be greater than 200 hectares.	£2.50 for each hectare of site area.
(c) The replacement of broadleaf high forest by conifer species, where the area involved would be greater than 10 hectares.	£40, or £2.50 for each hectare of site area, whichever is the greater.
(d) Peat extraction which would involve a new or extended area of 50 hectares or more.	£2.50 for each hectare of site area.".

EXPLANATORY NOTE.

These Regulations amend the Local Government (Planning and Development) (Fees) Regulations, 1984 ( S.I. No. 358 of 1984 ) to prescribe the fees payable to planning authorities, with effect from 15 July, 1991, in respect of applications for planning permission for certain forestry development, the use of uncultivated land or semi-natural areas for intensive agricultural purposes and peat extraction.
