ROAD TRAFFIC (LICENSING OF DRIVERS) (AMENDMENT) REGULATIONS, 1989 | ||
The Minister for the Environment. in exercise of the powers conferred on him by sections 5 , 23 (2), 31 , 33 , 34 , 35 , 38 (7) and 42 of the Road Traffic Act, 1961 (No. 24 of 1961) hereby makes the following Regulations:— 1. These Regulations may be cited as the Road Traffic (Licensing of Drivers) (Amendment) Regulations, 1989. 2. These Regulations shall come into operation on the 1st day of January, 1990. 3. The Road Traffic (Licensing of Drivers) Regulations ( S.I. No. 285 of 1989 ) are hereby amended by:— | ||
( a ) the substitution of the following sub-article for sub-article (3) of article 14:— | ||
"(3) A driving licence may be granted for a period of one year where the application for the licence is required under article 42 of these Regulations to be accompanied by a medical report and the medical report indicates that the applicant appears to require medical review within a period which is less than three years."; | ||
( b ) the insertion of the following article after article 19:— | ||
"19A. Notwithstanding sub-article (2) of article 19 of these Regulations, a provisional licence may be granted for a period of one year where the application for the licence is required under article 42 of these Regulations to be accompanied by a medical report and the medical report indicates that the applicant appears to require medical review within a period which is less than two years."; | ||
( c ) the addition to article 23 of the following sub-article:— | ||
"(3) Sub-article (2) of this article shall not apply to a provisional licence being granted to a person who held a provisional licence in relation to class C under the revoked Regulations prior to the 12th day of August, 1985."; | ||
( d ) the substitution of the following sub-article for sub-article (1) of article 27:—— | ||
"(1) The fee to be paid to the issuing authority on application for a certificate of competency shall be— | ||
( a ) £50 where the application relates to vehicles in category EC1, EC ED1 or ED, | ||
( b ) £40 where the application relates to vehicles in category C1, C, D1 or D, and | ||
( c ) £25 in any other case."; | ||
( e ) the substitution of the following sub-article for sub-article (2) of article 61:— | ||
"(2) References in these Regulations to a category of vehicles shall, unless the context otherwise requires, be construed as including references to the equivalent class of vehicles in accordance with this article save, however, that— | ||
( a ) a certificate of fitness in relation to class C under the revoked Regulations shall not be regarded as a certificate of fitness in relation to category C1 or EC1, and | ||
( b ) a provisional licence granted under the revoked Regulations in relation to class C, D or F shall not be regarded as provisional licence in relation to category EB, EC1, EC, ED1 or ED." and | ||
(f) the deletion of sub-article (6) of article 61. | ||

EXPLANATORY NOTE. | ||
These Regulations provide for the issue of provisional licences under the Road Traffic Act, 1961 for the period of one year (instead of two years) in certain cases where for medical reasons a longer term licence cannot be granted. They also provide for increased fees for driving tests and for certain other technical amendments to the Road Traffic (Licensing of Drivers) Regulations, 1989. |
