EUROPEAN COMMUNITIES (SAMPLING AND ANALYSIS OF FERTILISERS) REGULATIONS, 1989.

I, MICHAEL O'KENNEDY, Minister for Agriculture and Food, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Commission Directive No. 87/566/EEC, hereby make the following Regulations:

1. (1) These Regulations may be cited as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1989 and shall come into operation on the 15th day of July, 1989.

(2) The European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 ( S.I. No. 12 of 1978 ) the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1979 ( S.I. No. 409 of 1979 ), and these Regulations may be cited together as the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 to 1989.

2. Regulation 2 of the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1978 ( S.I. No. 12 of 1978 ), is hereby amended by the substitution for the definition of "the directive" (inserted by Regulation 2 of the European Communities (Sampling and Analysis of Fertilisers) Regulations, 1979 ( S.I. No. 409 of 1979 )) of the following definition:

'"the directive' means Commission Directive No. 77/535/EEC of 22 June, 1977(1) as amended by Commission Directive No. 79/138/EEC of 14 December, 1978(2) and Commission Directive No. 87/566/EEC of 24 November, 1987(3)".

EXPLANATORY NOTE.

The Regulations implement the provisions of Commission Directive 87/566/EEC which lays down official methods for sampling fluid and ammonium nitrate fertilisers marketed under the designation "EEC fertiliser".
