EUROPEAN COMMUNITIES (NON-AUTOMATIC WEIGHING MACHINES) (AMENDMENT) REGULATIONS, 1988.

I, ALBERT REYNOLDS, Minister for Industry and Commerce, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), and for the purpose of giving effect to Council Directive No. 73/360/EEC of 19 November, 19731, as amended by Commission Directive No. 76/696/EEC of 27 July, 19762 and Commission Directive No. 82/622/EEC of 1 July, 19823, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Non-Automatic Weighing Machines) (Amendment) Regulations, 1988.

2. These Regulations shall be deemed to have come into operation on the 1st day of January, 1988.

3. The European Community (Non-Automatic Weighing Machines) Regulations, 1979 ( S.I. No. 128 of 1979 ), are hereby amended by the substitution of the following paragraph for paragraph (1) (inserted by the European Communities (Non-Automatic Weighing Machines) (Amendment) Regulations, 1986 ( S.I. No. 440 of 1986 )) of Regulation 5:

"(1) There shall be charged in respect of each non-automatic weighing machine submitted for EEC initial verification to an inspector under the Weights and Measures Acts, 1878 to 1961, or to an officer of Eolas — The Irish Science and Technology Agency a fee of

(a) £0.76 in the case of a machine that is one of the first 50,000 machines so submitted on or after the 1st day of January, 1988, and

(b) a fee of £0.48 in the case of any other machine so submitted on or after the 1st day of January, 1988."

EXPLANATORY NOTE.

These Regulations set out the fees to be charged from the 1st January, 1988 for the EEC initial verification of non-automatic weighing machines.
