THE HEALTH RESEARCH BOARD (ESTABLISHMENT) ORDER, 1986 (AMENDMENT) ORDER, 1986.

The Minister of Health in exercise of the powers conferred on him by sections 3 to 6 of the Health (Corporate Bodies) Act, 1961 (No. 27 of 1961) hereby orders as follows:

1. This Order may be cited as the Health Research Board (Establishment) Order, 1986 (Amendment) Order, 1986.

2. The Health Research Board (Establishment) Order, 1986 ( S.I. No. 279 of 1986 ) shall be amended by the substitution for article 24 of the following article:

"24 (1) Subject to the provision of sub-articles (2), (3), (4) and (5) of this article the Local Government (Superannuation) Act, 1956 (No. 10 of 1956) and Schemes and Regulations made under the Local Government (Superannuation) Act, 1980 (No. 8 of 1980) shall apply to the Board as if it were a local authority.

(2) Notwithstanding the provisions of sub-article (1) the superannuation provisions which applied to persons immediately before the date of transfer to the Board pursuant to the dissolution of the Medical Research Board shall apply to such persons on transfer to the Board and the Local Government (Superannuation) Act, 1956 and Schemes, and Regulations made under the Local Government (Superannuation) Act, 1980 shall not apply as respects such persons.

(3) Notwithstanding the provisions of sub-article (1) the superannuation provisions of the Local Government (Superannuation) Act, 1956 and the Schemes and Regulations made under the Local Government (Superannuation) Act, 1980 as they applied to persons immediately before the date of their transfer to the Board pursuant to the dissolution of the Medico-Social Research Board shall continue so to apply to such persons on transfer to the Board.

(4) If on the 1st day of January, 1987 Dr. A. Radic, Dr. P. Kirke or Mrs. A. O'Hare are transferred to employment under the Board consequent on the dissolution of the Medico-Social Research Board, the provisions of sub-article (1) shall not apply to the said Dr. Radic, Dr. Kirke or Mrs. O'Hare unless they respectively elect in writing before the 31st day of March, 1987 that the said sub-article (1) shall apply to them.

(5) The Board may, in respect of persons referred to in sub-article (2) above, and persons referred to in sub-article (4) who do not elect that sub-article (1) shall apply to them, make appropriate contributions in respect of superannuation schemes to which such persons are members at the rate subsisting at the date of transfer or election."

EXPLANATORY NOTE.

The effect of this Order is to amend Article 24 of the Health Research Board Establishment Order in respect of certain employees transferred to employment under the Board.
