LOCAL GOVERNMENT (SUPERANNUATION REVISION) (JOB-SHARING) (AMENDMENT) SCHEME, 1985.

The Minister for the Environment, in exercise of the power conferred on him by sections 2 and 5 of the Local Government (Superannuation) Act, 1980 (No. 8 of 1980), with the consent of the Minister for the Public Service, hereby makes the following Scheme:

1 Short title.

1. This Scheme may be cited as the Local Government (Superannuation Revision) (Job-Sharing) (Amendment) Scheme, 1985.

2 Commencement.

2. This Scheme shall be deemed to have come into force on the 1st day of December, 1985.

3 Interpretation.

3. In this Scheme:

"approved job-sharing scheme" means a scheme or arrangements for the sharing of a wholetime office or employment by two officers or two employees

(i) where, in relation to officers or employees of a vocational education committee or school attendance committee, a job-sharing scheme has been approved by the Minister for Education,

(ii) where, in relation to officers or employees of a health board or other body, a job-sharing scheme has been approved by the Minister for Health, and

(iii) in any other case, where a job-sharing scheme has been approved by the Minister for the Environment.

"the Revision Scheme of 1984" means the Local Government (Superannuation Revision) Scheme, 1984 ( S.I. No. 33 of 1984 ).

4 Amendment of article 3 (1) of the Revision Scheme, 1984.

4. The definition of "eligible officer" in article 3(1) of the Revision Scheme of 1984 is hereby amended by the addition of the following paragraph:

"( c) is sharing a wholetime office with one other officer under a scheme or arrangements for the sharing of a wholetime office by two officers

(i) where, in relation to officers of a vocational education committee or school attendance committee, a job-sharing scheme has been approved by the Minister for Education,

(ii) where, in relation to officers of a health board or other body, a job-sharing scheme has been approved by the Minister for Health, and

(iii) in any other case, where a job-sharing scheme has been approved by the Minister.".

5 Amendment of clause 12 (2) of Part II of the First Schedule to the Revision Scheme, 1984.

5. For the purposes of subsection (2)(b) of section 27 of the Act of 1956, as substituted by clause 12(2) of Part II of the First Schedule to the Revision Scheme of 1984, the words "salary" and "emoluments" shall, as respects a registered officer who is sharing a wholetime office with one other officer under an approved job-sharing scheme, mean his "salary" and "emoluments", respectively, as increased by one hundred per cent.

6 Amendment of clause 2 of Part III of the First Schedule to the Revision Scheme, 1984.

6. Clause 2 of Part III of the First Schedule to the Revision Scheme of 1984 is hereby amended by the addition of the following paragraph:

"( c ) Subsection (3A) of section 34 of the Act of 1956 shall apply as if the words "two hundred and fifty" were substituted for the words "three hundred.".

7 Amendment of clause 10 of Part III of the First Schedule to the Revision Scheme, 1984.

7. As respects a registered employee who is sharing wholetime employment with one other employee under an approved job-sharing scheme, the provisions of clause 10 of Part III of the First Schedule to the Revision Scheme of 1984 shall apply as if the word "twice" were deleted before the words "the personal weekly rate of old age contributory pension" where such word occurs in sub-clauses (2), (4) and (6) of that clause.

8 Amendment of clause 14 (2) of Part III of First Schedule to the Revision Scheme, 1984.

8. For the purposes of subsection (2)(b) of section 47 of the Act of 1956, as substituted by clause 14(2) of Part III of the First Schedule to the Revision Scheme of 1984, the words "wages" and "emoluments" shall, as respects a registered the employee who is sharing wholetime employment with one other employee under an approved job-sharing scheme, mean his "wages" and "emoluments", respectively, as increased by one hundred per cent.

EXPLANATORY NOTE.

The effect of this Scheme is to amend the existing statutory superannuation provisions for the staff of local authorities (including health boards and certain other bodies) contained in the Local Government (Superannuation Revision) Scheme, 1984 ( S.I. No. 33 of 1984 ) to provide for the superannuation of persons who participate in approved job-sharing schemes.
