EUROPEAN COMMUNITIES (REMOVAL OF RESTRICTIONS ON IMMATURE SPIRITS) REGULATIONS, 1985.

I, ALAN M. DUKES, Minister for Finance, in exercise of the powers conferred on me by section 3 of the European Communities Act, 1972 (No. 27 of 1972), for the purpose of giving effect to Articles 5 and 30 of the EEC Treaty and having regard to the Reasoned Opinion of the European Communities dated the 17th day of June, 1985, hereby make the following Regulations:

1. These Regulations may be cited as the European Communities (Removal of Restrictions on Immature Spirits) Regulations, 1985, and shall come into operation on the 1st day of December, 1985.

2. In these Regulations "the Act of 1947" means the Immature Spirits (Restriction) Act, 1947 (No. 12 of 1947).

3. The following subsection is hereby substituted for subsection (1) of section 2 of the Act of 1947:

"(1) Subject to this section, no Irish spirits or foreign spirits shall be delivered for home consumption unless they have been warehoused for at least three years.".

4. The following is hereby substituted for paragraph (e) of subsection (3) of section 2 of the Act of 1947:

"(e) foreign liqueurs, or

(f) vodka, or

(g) rum.".

5. The following is hereby inserted in the Schedule to the Act of 1947:

EXPLANATORY NOTE

These Regulations, which come into operation on 1 December 1985 provide for the removal of the Compulsory Warehousing Requirements for Vodka and Rum.
