S.I. No. 151/1983 - Garda Síochána (Associations) (Amendment) Regulations, 1983.


I, MICHAEL NOONAN, Minister for Justice, in exercise of the powers conferred on me by section 13 of the Garda Síochána Act, 1924 (No. 25 of 1924), as amended by the Garda Síochána Act, 1977 (No. 24 of 1977), and section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Associations) (Amendment) Regulations, 1983.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The First Schedule to the Garda Síochána (Associations) Regulations, 1978 ( S.I. No. 135 of 1978 ), is hereby amended by—

( a ) the substitution in Article 3 (6) for "April" of "September",

( b ) the insertion after Article 3 (10) of the following:

"(11) Where a new district is formed or where an existing district is abolished, reduced or enlarged, the Central Executive Committee may make such temporary arrangements as they deem appropriate for all members permanently assigned to the district which is so formed, abolished, reduced or enlarged, as the case may be.",

( c ) the substitution for Articles 4 and 5 of the following:

Divisional Committees

"4. (1) For the purposes of paragraph (2) of this Article—

( a ) Garda Headquarters shall be deemed to be a division;

( b ) the Garda Training Centre at Templemore in the county of Tipperary shall be deemed to be a division; and

( c ) the Central Detective Unit and the Special Detective Unit in the Dublin Metropolitan Area shall together be deemed to be a division.

(2) There shall be a divisional committee for each division. The number of members of each committee shall be determined in accordance with paragraph (3) of this Article.

(3) Within one month of its election, each district committee shall elect one of its members for each 100, or portion of 100, members in the district to act as a member of the divisional committee.

(4) Each divisional committee shall elect from among its members a chairman and a secretary.

(5) A member of a divisional committee shall cease to hold office on his ceasing to be a member of the Association or on his being transferred permanently to another district.

(6) Where a vacancy occurs on a divisional committee, the district committee which elected the member whose place has become vacant may elect a substitute.

(7) Where a new division is formed or where an existing division is abolished, reduced or enlarged, the Central Executive Committee may make such temporary arrangements as they deem appropriate for all members permanently assigned to the division which is so formed, abolished, reduced or enlarged, as the case may be.",

( d ) the substitution for Article 6 (1) of the following:

"(1) At its first meeting after its election, each divisional committee shall elect one of its members to be a member of the Central Executive Committee. The members so elected shall constitute the Central Executive Committee.",

( e ) the substitution in Article 6 (3) for "regional" of "divisional",

( f ) the substitution in Article 7 (3) for "regional" of "divisional",

( g ) the substitution in Article 7 (5) for "seven regional" of "fourteen divisional", and

( h ) the substitution in Article 9 (3) for "regional" of "divisional".

4. The Second Schedule to the Garda Síochána (Associations) Regulations, 1978, is hereby amended by—

( a ) the substitution for Article 3 (4) of the following:

"(4) ( a ) In each division there shall be a branch of the Association which will consist of all members of the Association permanently assigned to the division.

( b ) Where a new division is formed or where an existing division is abolished, reduced or enlarged, the National Executive may make such temporary arrangements as they deem appropriate for all members permanently assigned to the division which is so formed, abolished, reduced or enlarged, as the case may be.",

( b ) the substitution in Article 3 (8) for "annually" of "biennially",

( c ) the insertion in Article 3 (11) after "another division" of "or on his failure to attend three consecutive meetings unless, in the opinion of the branch committee, he has good and sufficient cause for such failure",

( d ) the substitution in Article 4 (5) for "in the month of April" of "on or before the last day of the month of April",

( e ) the substitution for Article 5 (1) of the following:

"(1) The National Executive shall be elected biennially and shall consist of eleven members, eight of whom shall be elected by postal ballot vote and three by an Annual Delegate Conference.",

( f ) the substitution for Article 5 (3) of the following:

"(3) The three members to be elected by an Annual Delegate Conference shall be members of the Conference nominated by their branches as candidates for election to the National Executive.",

( g ) the insertion in Article 5 (4) after "the Association" of "or on his failure to attend three consecutive meetings unless, in the opinion of the National Executive, he has good and sufficient cause for such failure",

and

( h ) the substitution in Article 6 (1) for "The Annual Delegate Conference shall elect a President" of "The President shall be elected biennially by an Annual Delegate Conference".

EXPLANATORY NOTE.

These Regulations amend, in a number of minor respects, the Garda Síochána (Associations) Regulations, 1978.
