Oireachtas (Allowances To Members) and Ministerial, Parliamentary and Judicial Offices (Amendment) Act, 1983

Amendment of section 6A of Oireachtas (Allowances to Members) Act, 1938.

4.—(1) Section 6A (inserted by the Oireachtas (Allowances to Members) and Ministerial and Parliamentary Offices (Amendment) Act, 1960) of the Oireachtas (Allowances to Members) Act, 1938 , is hereby amended by the substitution for subsection (4) (inserted by the Superannuation and Pensions Act, 1963 ) of the following subsections:

“(4) The Minister may make a scheme amending or revoking a scheme under this section (including a scheme under this subsection).

(4A) Every scheme made under subsection (4) of this section shall be laid before each House of the Oireachtas as soon as may be after it is made and, if a resolution annulling the scheme is passed by either such House within the next twenty-one days on which that House has sat after the scheme is laid before it, the scheme shall be annulled accordingly, but without prejudice to the validity of anything previously done thereunder.”.

(2) The references in the said section 6A to pensions for members of the Oireachtas shall be construed as references to pensions, gratuities and other allowances on death or on ceasing otherwise to hold office as members of the Oireachtas for or in respect of such members and the reference in subsection (3) of that section to that section shall be construed as a reference to subsection (2) of that section.
