EUROPEAN COMMUNITIES (INTRODUCTION OF ORGANISMS HARMFUL TO PLANTS OR PLANT PRODUCTS) (PROHIBITION) (AMENDMENT) REGULATIONS, 1982. | ||
I, BRIAN LENIHAN, Minister for Agriculture, considering there is an imminent danger of the introduction or spread in the State of the harmful organism Dendroctonus micans Kugelan (being a danger described in Article 15 of Council Directive No. 77/93/EEC(1) of 21 December, 1976), in exercise of the powers conferred on me by Section 3 of the European Communities Act, 1972 (No. 27 of 1972), hereby make the following Regulations:— | ||
1 O.J. No. L26, 31.1.1977. 1. (1) These Regulations may be cited as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) Regulations, 1982. | ||
(2) The European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 and 1981, and these Regulations may be cited together as the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 to 1982. 2. The European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) Regulations, 1980 ( S.I. No. 125 of 1980 ), are hereby amended by the insertion of the following Regulation after Regulation 2A (inserted by Regulation 3 of the European Communities (Introduction of Organisms Harmful to Plants or Plant Products) (Prohibition) (Amendment) Regulations, 1980 ( S.I. No. 258 of 1980 )): | ||
"2B (1) A person shall not introduce into the State— | ||
( a ) cut plants of any coniferous species with foliage or bark attached, or | ||
( b ) rooted plants of any such species above two metres in height. | ||
(2) Paragraph (1) of this Regulation shall not apply to cut or other plants which are grown in and imported from Northern Ireland. | ||
(3) Any person who contravenes paragraph (1) of this Regulation shall be guilty of an offence and shall be liable on summary conviction to a fine not exceeding £300." | ||

EXPLANATORY NOTE. | ||
The Regulations prohibit the import of cut plants and certain rooted plants of coniferous tree species as a precaution against the introduction of a forest-tree pest known as Great Spruce Bark Beetle. |
