MILK AND DAIRIES (FEES FOR BACTERIOLOGICAL EXAMINATION) (AMENDMENT) REGULATIONS, 1982.

The Minister for Health, in exercise of the powers conferred on her by sections 15 and 50 of the Milk and Dairies Act, 1935 (No. 22 of 1935) as adapted by the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S.R. & O. 1947 No. 58), hereby orders as follows:—

1. These Regulations may be cited as the Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1982.

2. The Interpretation Act, 1937 (No. 38 of 1937) shall apply to these Regulations as it applies to the interpretation of an Act of the Oireachtas.

3. These Regulations shall come into operation on the 1st day of March, 1982.

4. In these Regulations

"The Principal Regulations" means the Milk and Dairies (Fees for Bacteriological Examination) Regulations, 1936 (S.R. and O. 1937 No. 16);

"the Regulations of 1962" means the Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1962 ( S.I. No. 233 of 1962 ).

5. Article 3 of the Principal Regulations is hereby amended by the substitution of "two pounds" for "fifteen shillings" (substituted therein by the Regulations of 1962).

6. The Table of Fees in article 4 of the Principal Regulations is hereby amended by—

( a ) the substitution in paragraph (1) of "three pounds" for "one pound" (substituted therein by the Regulations of 1962) after "For each cultural examination";

( b ) the substitution in paragraph (2) of "two pounds" for "fifteen shillings" (substituted therein by the Regulations of 1962) after "For each serological examination";

( c ) the substitution in paragraph (3) after "for each biological examination" of—

"( a ) if two animals are used—ten pounds;

( b ) if one animal only is used—six pounds";

for the following (substituted therein by the Regulations of 1962)

"( a ) if two animals are used—three pounds;

( b ) if one animal only is used—two pounds";

( d ) the substitution in paragraph (4) of "two pounds" for "ten shillings" (substituted therein by the Regulations of 1962) after "For each microscopic examination".

7. The Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1962 ( S.I. No. 233 of 1962 ) are hereby revoked.

EXPLANATORY NOTE.

These regulations provide for increases in the fees payable to bacteriological examiners for the examination and testing of milk samples under the Milk and Dairies Act, 1935 .
