S.I. No. 26 of 1982.

REGISTRATION OF BIRTHS, DEATHS AND MARRIAGES (FEES AND ALLOWANCES) REGULATIONS, 1982.

The Minister for Health in exercise of the powers conferred by sections 6 and 9 of the Vital Statistics and Births, Deaths and Marriages Registration Act, 1952 (No. 8 of 1952), with the consent of the Minister for Finance hereby makes the following Regulations:—

1. These Regulations may be cited as the Registration of Births, Deaths and Marriages (Fees and Allowances) Regulations, 1982.

2. These Regulations shall come into operation on the 1st day of March, 1982.

3. ( a ) the amount of the fee for each entry in an account of the births, deaths or marriages registered by a Registrar, fixed by an enactment to which this article applies, is hereby altered to fifty pence.

( b ) The enactments to which this article applies are:—

(i) section 54 of the Registration of Births and Deaths (Ireland) Act, 1863;

(ii) section 21 of the Registration of Marriages (Ireland) Act, 1863 as amended by section 3 of the Registration of Marriages Act, 1936 (No. 35 of 1936).

4. The amount of the allowance payable under section 3 of the Registration of Births and Deaths Act, 1936 (No. 34 of 1936) is hereby altered to:—

( a ) one hundred pounds in respect of each year; and

( b ) in the case of a part of a year during which a Registrar has held office, an amount bearing to one hundred pounds the same ratio as the said part of such year bears to one year.

5. The amount of the allowance payable under section 2 of the Registration of Marriages Act, 1936 , is hereby altered to—

( a ) twenty-five pounds in respect of each year; and

( b ) in the case of a part of a year during which a Registrar has held office, an amount bearing to twenty-five pounds the same ratio as the said part of such year bears to one year.

6. The amount of the fee for each entry in the certified copies of registers of births and deaths fixed by section 53 of the Registration of Births and Deaths (Ireland) Act, 1863, is hereby altered to ten pence.

7. The amount of the fee for each entry in the certified copies of registers of marriages fixed by section 20 of the Registration of Marriages (Ireland) Act, 1863, is hereby altered to ten pence.

8. ( a ) The amount of the fee for each certified copy of any entry in a register of births, deaths or marriages fixed by each of the enactments to which this article applies is hereby altered to one pound.

( b ) The enactments to which this article applies are:—

sections 68, 69 and 70 of the Marriages (Ireland) Act, 1844;

sections 17, 18 and 19 of the Registration of Marriages (Ireland) Act, 1863;

section 50 of the Registration of Births and Deaths (Ireland) Act, 1863;

sections 23 and 25 of, and the Second Schedule to, the Births and Deaths

Registration Act (Ireland), 1880.

9. The amount of the fee for each short birth certificate (as defined in the Short Birth Certificate Regulations 1953 ( S.I. No. 215 of 1953 )) is hereby altered to twenty five pence.

10. ( a ) The amount of the fee for each particular search fixed by each of the enactments to which this article applies is hereby altered to fifty pence.

( b ) The enactments to which this article applies are:—

sections 69 and 70 of the Marriages (Ireland) Act, 1844;

sections 17, 18 and 19 of the Registration of Marriages (Ireland) Act, 1863;

section 50 of the Registration of Births and Deaths (Ireland) Act, 1863;

sections 23 and 25 of, and the Second Schedule to, the Births and Deaths Registration Act (Ireland), 1880.

11. The amount of the fee for each search fixed by section 68 of the Marriages (Ireland) Act, 1844 is hereby altered to fifty pence for every search extending over a period not more than one year and twenty-five pence additional for every additional year.

12. ( a ) The amount of the fee for each general search fixed by each of the enactments to which this article applies is hereby altered to five pounds.

( b ) The enactments to which this article applies are:—

section 70 of the Marriages (Ireland) Act, 1844;

section 17 of the Registration of Marriages (Ireland) Act, 1863;

section 50 of the Registration of Births and Deaths

(Ireland) Act, 1863.

13. ( a ) The amount of the fee for each general search fixed by each of the enactments to which this article applies is hereby altered to two pounds.

( b ) The enactments to which this article applies are:—

section 69 of the Marriages (Ireland) Act, 1844;

section 18 of the Registration of Marriages (Ireland) Act, 1863;

section 23 of, and the Second Schedule to, the Births and Deaths

Registration Act (Ireland), 1880.

14. The fees fixed by section 23 of, and the Second Schedule to, the Births and Deaths Registration Act (Ireland), 1880 are hereby altered to the following amounts:—

( a ) for registration of a birth after three months and within twelve months, seventy-five pence;

( b ) for registration of a birth or death after twelve months, one pound and twenty-five pence;

( c ) for taking, attesting and transmitting a declaration respecting a birth which occurred in another district, fifty pence;

( d ) for entering the baptismal or other name upon a certificate produced after registry of birth, fifty pence and

( e ) for correction of an error of fact or substance in a register of births or deaths, seventy-five pence.

15. The amount of the fee for a certificate of the registration of a birth, fixed by section 24 of the Births and Deaths Registration Act (Ireland) 1880, is hereby altered to ten pence.

16. The amount of the fee for:—

( a ) each entry in the Marriage Notice Book fixed by section 14 of the Marriages (Ireland) Act, 1844 is hereby altered to fifty pence;

( b ) each certificate of an entry in the Marriage Notice Book fixed by section 16 of the said Act, is hereby altered to one pound;

( c ) each licence for marriage, fixed by section 21 of the said Act, is hereby altered to two pounds;

( d ) entering a caveat against the grant of a certificate or a licence for a marriage, fixed by section 23 of the said Act, is hereby altered to one pound and twenty-five pence and

( e ) each marriage solemnised in the presence of a Registrar of marriages, fixed by section 31 of the said Act, is hereby altered to four pounds where the marriage is by licence or otherwise to two pounds.

17. The amount of the fee for each registered letter containing a copy of notice of intended marriage sent by the Registrar of marriages fixed by section 3 of the Marriage Law (Ireland) Amendment Act, 1863, is hereby altered to one pound.

18. ( a ) The amount of the fee fixed for the registration of a place of public worship by each of the enactments to which this article applies is hereby altered to twelve pounds and fifty pence;

( b ) The enactments to which this article applies are:—

sections 7, 27 and 28 of the Marriages (Ireland) Act, 1844;

section 12 of the Marriage Law (Ireland) Amendment Act, 1863.

EXPLANATORY NOTE.

The effect of this Order is to increase from the 1st March, 1982 the entry fees and allowances payable to Registrars of Births, Deaths and Marriages, the checking fees payable to individual Superintendent Registrars and the fees payable to (a) Oifig An Ard-Chláraitheora (b) Superintendent Registrars and (c) Registrars of Births, Deaths and Marriages for searches, certificates and other registration services.
