S.I. No. 211/1981 - Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1981.

The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

Citation

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1981.

Commencement

2. These Regulations shall come into operation on the 15th day of June, 1981.

Interpretation

3. In these Regulations save where the context otherwise requires

“the Act” means the Road Traffic Act, 1961 ;

“road” means a public road;

“perimeter road” means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

“special speed limit” and “built-up area speed limit” have the meanings respectively assigned to them in Part IV of the Act;

“distance” means distance as measured along the centre line of a road.

Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit

5. (1) Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

(2) Fifty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule to these Regulations.

Exceptions

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

Revocation

7. The Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1977 ( S.I. No. 370 of 1977 ) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Bantry:—

(a) The Sheskin Road, Hospital Road, The Inchiclough Road, Fairy Lane, The Slippery Slat Road, Beach Road, The Rooska Road.

(b) The Glengarriff Road for a distance of 1,156 metres from the town boundary.

(c) The road joining the Bantry-Glengarriff road at Newtown between the town boundary and the junction of the said road with the Bantry-Glengarriff road.

(d) The Droumclough Road between the town boundary and a point 28 metres east of its junction with the Caherdaniel Road.

(e) The Ardnageehy or Quarry Well Road between the town boundary and a point 18 metres west of its junction with the Hospital Road.

(f) The Dromleigh Road between the town boundary and a point 19 metres south of its junction with Scart Road.

(g) The back road to the Hospital.

(h) The Ropewalk between its junction with the Cork Road and a point 138 metres south-west of its junction with Scart Road.

(i) The Cork Road between the town boundary and a point 503 metres west of its junction with the Square.

(j) The Caherdaniel Road between the town boundary and a point 192 metres east of its junction with the Droumclough Road.

2. The following roads in the Urban District of Clonakilty:—

(a) The Fern Hill Road, The Desert Road, The Flaxmill Road, The Rocky Road, The Lackenagobidane Road.

(b) The Skibbereen Road between the urban district boundary and a point 41 metres west of its junction with the Ballineen Road.

(c) The Ballineen Road between the urban district boundary and a point 325 metres north of its junction with the Skibbereen Road.

(d) The Bog or Fairfield Road between the urban district boundary and a point 92 metres west of Fair Green.

(e) The road connecting Lady's Cross with Clogheen Cross, North.

(f) Gravel Pit Road between its junction with the Ballineen Road and a point 307 metres north-west of its junction with the Skibbereen Road.

(g) The Ballinaffrin Road between the urban district boundary and a point 61 metres north-west of its junction with Patrick Street.

(h) The Shannonvale or Scartagh Road for a distance of 512 metres from the point where the urban district boundary intersects the eastern side of the road.

(i) The road through the townland of Cappeen connecting the Shannonvale or Scartagh Road with the Bandon Road.

(j) The Tubereen Road between the urban district boundary and a point 28 metres north-east of its junction with the Ring Road.

(k) The Ring Road between the urban district boundary and a point 46 metres south-east of its junction with the Tubereen Road.

(l) The Youghal Road between the urban district boundary and a point 55 metres east of its northern junction with Dispensary Hill.

(m) The Ardfield or Snugborough Road between the urban district boundary and a point 46 metres south-east of its junction with the Clogheen Road.

(n) The Lislevane Road through the townland of Curraghgrane More where the said road is a perimeter road.

(o) The Clogheen Road between the urban district boundary and a point 78 metres south of its junction with the Ardfield or Snugborough Road.

(c) The Ballyhooly Road between its northernmost intersection by the county borough boundary and a point 92 metres north-east of its junction with Gordon's Lane.

(d) The Mallow Road between the county borough boundary and a point 138 metres north-west of its junction with Dublin Hill Road.

(e) The Commons Road and its continuation as the Old Blarney Road between the county borough boundary and a point 101 metres north-west of its junction with Fitz's Boreen.

(f) The Fair Hill Road for a distance of 914 metres from the point where the county borough boundary intersects the north-eastern side of the road.

(g) The Holly Hill Road between the county borough boundary and a point 64 metres north-west of its junction with Blarney Street.

(a) The Castletownbere-Kenmare road between a point 200 metres south-west of its junction with the Glenbeg Road and a point 90 metres north-east of its junction with the Reenavaude Road.

(b) The Canfie Road for a distance of 80 metres from its junction with the Castletownbere-Kenmare road.

(d) The Reenavaude Road for a distance of 70 metres from its junction with the Castletownbere-Kenmare road.

2. The following roads at Ballincollig:—

(a) The Square.

(b) The Cork-Macroom road between a point 105 metres north-east of Carrigrohane Cross and a point 1,220 metres south-west of its junction with the Classis Road.

(i) a point on the Cork Road 138 metres north-east of its junction with the Old Quay Road,

(ii) a point on the Ballylangley Road 455 metres north-east of its junction with the Old Quay Road,

(iii) a point on the Ballinadee Road 115 metres south-east of the Mill Cross,

(iv) a point on Parnell Street 200 metres south of the south-western end of Ardán na nóglach,

(v) a point on the Casement Road 300 metres from the boundary of the town of Bandon,

(a) The Cloghroe Road between a point 55 metres north-west of its junction with the Pound Cross Road and a point 50 metres north-west of Leemount crossroads.

(b) The Healy's Bridge Road for a distance of 30 metres from its junction with the Cloghroe Road.

21. The following roads at Carrigtwohill:—

(a) The Cork-Youghal road between a point 46 metres east of the centre line of Carrigtwohill Bridge and a point 119 metres east of its junction with the Carrigane Road.

24. The following roads at Castletown-Bearhaven:—

(a) The Back Road, The Farm Road, The Pier Road.

(b) The Glengarriff-Allihies road between a point 456 metres south-east of its junction with Rodeen Road and a point 138 metres west of its junction with the Tallon Road.

(d) The Toormore Road for a distance of 92 metres from its junction with the Back Road.

(e) The Tallon Road for a distance of 138 metres from its junction with the Glengarriff-Allihies road.

26. The following roads at Churchtown:—

(a) The Liscarroll-Rathluirc road between a point 135 metres west of its junction with the Rath Road and a point 270 metres east of its junction with the Buttevant Road.

(b) The Buttevant Road for a distance of 290 metres from its junction with the Liscarroll-Rathluirc road.

27. The following roads at Cloghroe:—

(a) The Cork-Nad-Banteer road between a point 20 metres north-west of its junction with the Matehy Road and a point 155 metres north-west of its junction with the Ballyanly Road.

(b) The Matehy Road for a distance of 20 metres from its junction with the Cork-Nad-Banteer road.

28. The following roads in and adjacent to the Urban District of Clonakilty:—

(a) The Cork Road between the point where the boundary of the urban district of Clonakilty intersects the eastern side of the road and a point 95 metres north of its junction with the Timoleague Road.

(b) The Timoleague Road for a distance of 95 metres from its junction with the Cork Road.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations replace the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1977 ( S.I. No. 370 of 1977 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 m.p.h. prescribed by section 45 of the Road Traffic Act, 1961 .

The Regulations declare that the roads mentioned in the Second Schedule, which would otherwise be outside the scope of the built-up area speed limit of 30 m.p.h., shall be subject to that limit.

The Regulations prescribe a speed limit of 40 m.p.h. in respect of the public roads mentioned in the Third Schedule and a speed limit of 50 miles per hour in respect of the public roads mentioned in the Fourth Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
