S.I. No. 211/1981 - Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1981.


The Minister for the Environment in exercise of the powers conferred on him by sections 5 , 45 and 46 of the Road Traffic Act, 1961 (No. 24 of 1961) amended as regards the said section 46 by section 25 of the Road Traffic Act, 1968 (No. 25 of 1968) hereby makes the following Regulations:—

Citation

1. These Regulations may be cited as the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1981.

Commencement

2. These Regulations shall come into operation on the 15th day of June, 1981.

Interpretation

3. In these Regulations save where the context otherwise requires

“the Act” means the Road Traffic Act, 1961 ;

“road” means a public road;

“perimeter road” means a road on and along the roadway of which there runs the boundary of a county or other borough, an urban district or a town;

“special speed limit” and “built-up area speed limit” have the meanings respectively assigned to them in Part IV of the Act;

“distance” means distance as measured along the centre line of a road.

Built-up area speed limit

4. (1) Each of the roads described in the First Schedule to these Regulations is hereby declared not to be a public road in a built-up area for the purposes of section 45 of the Act.

(2) Each of the roads described in the Second Schedule to these Regulations is hereby declared to be a public road in a built-up area for the purposes of section 45 of the Act.

Special speed limit

5. (1) Forty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Third Schedule to these Regulations.

(2) Fifty miles per hour shall be the speed limit for mechanically propelled vehicles on the roads specified in the Fourth Schedule to these Regulations.

Exceptions

6. There shall be excepted from the special speed limit prescribed in article 5 of these Regulations and from the built-up area speed limit the following:—

(a) ambulances,

(b) fire brigade vehicles, and

(c) vehicles used by members of the Garda Síochaána in the performance of their duties as such members.

Revocation

7. The Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1977 ( S.I. No. 370 of 1977 ) are hereby revoked.

FIRST SCHEDULE

Roads declared not to be public roads in a built-up area for the purposes of section 45 of the Road Traffic Act, 1961 .

1. The following roads in the town of Bantry:

(a) The Sheskin Road, Hospital Road, The Inchiclough Road, Fairy Lane, The Slippery Slat Road, Beach Road, The Rooska Road.

(b) The Glengarriff Road for a distance of 1,156 metres from the town boundary.

(c) The road joining the Bantry-Glengarriff road at Newtown between the town boundary and the junction of the said road with the Bantry-Glengarriff road.

(d) The Droumclough Road between the town boundary and a point 28 metres east of its junction with the Caherdaniel Road.

(e) The Ardnageehy or Quarry Well Road between the town boundary and a point 18 metres west of its junction with the Hospital Road.

(f) The Dromleigh Road between the town boundary and a point 19 metres south of its junction with Scart Road.

(a) The Cloyne-Garryvoe road between a point 25 metres east of its junction with the Ballycotton Road and a point 315 metres east of its junction with the North Road.

(b) The North Road for a distance of 320 metres from its junction with the Cloyne-Garryvoe road.

40. The following road in the Urban District of Skibbereen:

The Cork Road between the urban district boundary and a point 46 metres east of Callaghan's Cross.

41. The following roads at Tullylease:

(a) The Dromcollogher-Freemount road between a point 225 metres north of its junction with the Broadford Road and a point 15 metres north-west of Pound crossroads.

(b) The Broadford Road for a distance of 185 metres from its junction with the Dromcollogher-Freemount road.

42. The following roads at Waterfall:

(a) The road leading from Memorial Cross to Corbally Cross between its junction with the Waterfall Road and a point 20 metres north-east of the centre line of the railway bridge.

(b) The Waterfall Road between a point 795 metres south-west of the centre line of the Twopot Bridge and a point 150 metres south of Memorial Cross.

43. The following roads at Whitegate:

(a) The Midleton-Carlisle Fort road between a point 30 metres north of its junction with the Carrystown Hill Road and a point 565 metres south-west of the said junction.

(b) The Old Road between its northernmost and southernmost junction with the Midleton-Carlisle Fort road.

(c) The Careystown Hill Road for a distance of 600 metres from its junction with the Midleton Carlisle Fort road.

(d) The Lower Road for a distance of 50 metres from its junction with the Midleton-Carlisle Fort road.

(e) The Old Roches Point Road for a distance of 335 metres from its junction with the Midleton-Carlisle Fort road.

44. The following roads in and adjacent to the Urban District of Youghal:

(a) Kilcoran Place.

(b) The Waterford Road between a point 229 metres south-east of its junction with the Quarry Road and a point 320 metres north of the said junction.

(c) The Killeagh Road between a point 32 metres west of its junction with the Kilcoran Road and a point 525 metres west of its junction with the road connecting the Killeagh Road with the Claycastle Strand Road.

(d) The New Line Road for a distance of 183 metres from its junction with the Killeagh Road.

(e) The Bawnmore Road between its junction with the New Line Road and a point 18 metres south-west of its junction with Kilcoran Road.

(f) The road connecting the Bawnmore Road with the Killeagh Road.

FOURTH SCHEDULE

Roads in respect of which a special speed limit of 50 miles per hour is prescribed.

1. The following roads at Ballyhea:

(a) The Rathluirc-Buttevant road between a point 183 metres north of its junction with the Kilfinnane Road and a point 183 metres south of the said junction.

(b) The Kilfinnane Road for a distance of 20 metres from its junction with the Rathluirc-Buttevant road.

(c) The Ardnageehy Road for a distance of 20 metres from its junction with the Rathluirc-Buttevant road.

EXPLANATORY NOTE.

(This note is not part of the Instrument and does not purport to be a legal interpretation.)

These Regulations replace the Road Traffic (Speed Limits) (County Borough of Cork and County of Cork) Regulations, 1977 ( S.I. No. 370 of 1977 ) and alter the speed limits applicable to certain roads in this area.

The Regulations exclude the public roads mentioned in the First Schedule from the scope of the built-up area speed limit of 30 m.p.h. prescribed by section 45 of the Road Traffic Act, 1961 .

The Regulations declare that the roads mentioned in the Second Schedule, which would otherwise be outside the scope of the built-up area speed limit of 30 m.p.h., shall be subject to that limit.

The Regulations prescribe a speed limit of 40 m.p.h. in respect of the public roads mentioned in the Third Schedule and a speed limit of 50 miles per hour in respect of the public roads mentioned in the Fourth Schedule.

Ambulances, fire brigade vehicles and Garda Síochána vehicles while being used in the course of duty are excepted from all speed limits by the Regulations.
