WARBLE FLY (NOTIFICATION AND TREATMENT) (AMENDMENT) ORDER, 1977.

I, MARK CLINTON, Minister for Agriculture and Fisheries, in exercise of the powers conferred on me by sections 3 , 12 , 13 , 25 and 27 of the Diseases of Animals Act, 1966 (No. 6 of 1966), hereby order as follows:

1. (1) This Order may be cited as the Warble Fly (Notification and Treatment) (Amendment) Order, 1977.

(2) The Warble Fly (Notification and Treatment) Order, 1975 ( S.I. No. 267 of 1975 ), and this Order may be cited together as the Warble Fly (Notification and Treatment) Orders, 1975 and 1977.

2. The Warble Fly (Notification and Treatment) Order, 1975, is hereby amended by the substitution of the following Article for Article 6:

"6. (1) Where a diseased or suspected animal is found in the possession or charge of any person, an authorised person may serve a notice in writing on the person requiring him to have the animal treated for warbles before the expiration of a period of not less than fourteen days beginning on the date of the notice and ending on a day therein specified. Until the requirement of the notice has been complied with no person shall move the animal out of the land or premises on which it happens to be on the date of the notice unless it is accompanied either by a licence granted by the Minister in that behalf or by a permit authorising the movement and issued either by an inspector or by an authorised person.

(2) In case a notice is served under this section, an inspector or an authorised person may at anytime after the expiration of the period specified in the notice require the person on whom the notice was served to produce a certificate of treatment relating to the animal to which the notice relates."

EXPLANATORY NOTE.

This Order amends Article 6 of the Warble Fly (Notification and Treatment) Order, 1975 to provide that where a notice has been served on a person requiring him to have an animal treated for warbles, the notice must be complied with by a specified date and a certificate of treatment produced in relation to the animal concerned.
