S.I. No. 78/1975 - Garda Síochána (Retirement) Regulations, 1975.


I, PATRICK COONEY, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Retirement) Regulations, 1975.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Garda Síochána (Retirement) Regulations, 1934 ( S.R. & O. No. 146 of 1934 ) are hereby amended by the insertion after subparagraph (9) (inserted by the Garda Síochána (Retirement) (No. 3) Regulations, 1974 ( S.I. No. 345 of 1974 )) of paragraph 5 of the following subparagraph—

"(10) Notwithstanding the provisions of subparagraph (1) of this paragraph, a member of the Garda Síochána who would be due to retire under the provisions of the said subparagraph (1) may continue to serve in an established capacity in the Garda Síochána for a period which does not exceed the shortest period that would enable him to benefit in his superannuation award because of general pay increases to members of the Garda Síochána in common with other employees in the public service and which, in any case, does not exceed three calendar months".

EXPLANATORY NOTE.

These regulations provide for the extension of the service of members of the Garda Síochána who are due to retire on reaching the statutory age limit for a period not exceeding three calendar months.
