AIR NAVIGATION (RULES OF THE AIR) (AMENDMENT) ORDER, 1968.

I, ERSKINE H. CHILDERS, Minister for Transport and Power, in exercise of the powers conferred on me by Section 5 of the Air Navigation and Transport Act, 1946 , (No. 23 of 1946), and the Transport, Fuel and Power (Transfer of Departmental Administration and Ministerial Functions) Order, 1959 ( S.I. No. 125 of 1959 ), hereby order as follows:—

1. This Order may be cited as the Air Navigation (Rules of the Air) (Amendment) Order, 1968.

2. In this Order "the Principal Order" means the Air Navigation (Rules of the Air) Order, 1963 ( S.I. No. 7 of 1963 ) as amended by the Air Navigation (Rules of the Air) (Amendment) Order, 1966 ( S.I. No. 273 of 1966 ) and the Air Navigation (Rules of the Air) (Amendment) (No. 2) Order, 1967 ( S.I. No. 272 of 1967 ).

3. This Order shall come into operation on the 8th day of February, 1968.

4. The Principal Order and this Order may be cited together as the Air Navigation (Rules of the Air) Orders, 1963 to 1968.

5. Each provision of the Schedule to the Principal Order mentioned in column (1) of the Schedule to this Order is hereby amended in the manner stated in column (2) of the Schedule to this Order opposite the mention of that provision in the said column (1).

Rule 21

The substitution for paragraph (4) of the following:—

"(4) A flight plan shall comprise such information as may beprescribed."

The deletion of paragraphs (5) and (6).

The insertion in paragraph 8 after the word "arrival" in the first line of the following; "containing such information as may be prescribed."

Rule 32

The substitution for paragraph (3) (c) of the following:—

"(3) (c) Change in Estimated Times :

If the estimated time at the next applicable reporting point, flight information region boundary, or aerodrome of intended landing, whichever comes first, is found to be in error in excess of three minutes from that notified to air traffic services, or such other period of time as is prescribed by the appropriate authority a revised estimated time shall be notified as soon as possible to the appropriate air traffic services unit."

The substitution for paragraph (4) (a) of the following:—

"(4) (a) Change of Cruising Level :

Aircraft identification ; requested new cruising level and cruising speed at this level ; revised estimated time (when applicable) at subsequent flight information region boundaries."

Rule 32

The substitution for paragraph (4) (b) of the following :—

"(4) (b) Change of route :

(i) Destination unchanged : Aircraft identification ; flight rules ; description of new route of flight including related flight plan data beginning with the time and position from which requested change of route is to commence ; revised estimated time at destination; any other pertinent information.

(ii) Destination changed : Aircraft identification ; flight rules ; description of new route of flight to new destination including related flight plan data, beginning with the time and position from which requested change of route is to commence ; estimated time of arrival at new destination ; alternate aerodrome(s) ; any other pertinent information."

EXPLANATORY NOTE.

This Order amends the Air Navigation (Rules of the Air) Orders, 1963 to 1968 in order to bring them into conformity with Annex 2 of the Chicago Convention as amended by Amendment 10. The changes, are of a minor nature.
