GROUND RENTS REGISTERS REGULATIONS, 1967

I, BRIAN LENIHAN, Minister for Justice, in exercise of the powers conferred on me by section 34 of the Landlord and Tenant (Ground Rents) Act, 1967 (No. 3 of 1967), and, in so far as the regulations prescribe fees, with the concurrence of the Minister for Finance, hereby make the following regulations:

1. These Regulations may be cited as the Ground Rents Registers Regulations, 1967.

2. In these Regulations "the Act" means the Landlord and Tenant (Ground Rents) Act, 1967 (No. 3 of 1967).

3. (1) The form set out in Part I of the First Schedule to these Regulations is hereby prescribed for the purposes of section 21 (1) (a) of the Act as the form of register of arbitration awards in relation to the price of the fee simple in land being acquired under the Act.

(2) The form set out in Part II of the First Schedule to these Regulations is hereby prescribed for the purposes of section 21 (1) (b) of the Act as the form of register of all other arbitration awards under the Act.

4. The Circuit Court Office to which any county registrar is attached is hereby prescribed for the purposes of section 21 (2) of the Act as the place at which the registers kept by that county registrar under the said section 21 shall be made available to the public and the times during which that office is normally open to the public are hereby prescribed for the purposes of the said section 21 (2) as the times during which the registers shall be so made available.

5. Each fee set out in the second column of the Second Schedule to these Regulations is hereby prescribed for the purposes of section 21 (2) of the Act as the fee to be charged for the item mentioned in the first column of that schedule opposite the mention of the fee.

EXPLANATORY NOTE

These regulations prescribe

(a) the forms in which registers of awards are to be kept by county registrars,

(b) the places and times at which such registers are to be made available to the public, and

(c) the fees to be charged for inspecting registers and for copies of entries in them.
