S.I. No. 34/1965 - Garda Síochána (Retirement) Regulations, 1965.


I, BRIAN J. LENIHAN, Minister for Justice, in exercise of the powers conferred on me by section 14 of the Police Forces Amalgamation Act, 1925 (No. 7 of 1925), hereby, with the approval of the Government, make the following regulations:

1. These Regulations may be cited as the Garda Síochána (Retirement) Regulations, 1965.

2. The Interpretation Act, 1937 (No. 38 of 1937), applies to these Regulations.

3. The Garda Síochána (Retirement) Regulations, 1934 (S.R. & O., No. 146 of 1934), are hereby amended by the substitution for subparagraph (2) of paragraph 5 (inserted by the Garda Síochána (Retirement) Regulations, 1951 (S.R. & O., No. 132 of 1951), of the following paragraph:

"(2) Notwithstanding the foregoing provisions of this paragraph—

(a) the Commissioner may, with the consent of the Minister, extend, where it appears to be in the interests of the efficiency of the Garda Síochána so to do, the age at which any member of the Garda Síochána (other than the Commissioner) would retire under the said foregoing provisions by such period, not exceeding two years, as the Commissioner shall determine, and

(b) the Minister may, with the approval of the Government, where it appears to be in the interests of the efficiency of the Garda Síochána so to do, extend by periods of a year but not exceeding in the aggregate five years the age at which the Commissioner would retire under the said foregoing provisions."

EXPLANATORY NOTE.

These Regulations provide for the extension of the compulsory retiring age of the Commissioner, Garda Síochána.
