RESTRICTIVE TRADE PRACTICES (INTOXICATING LIQUOR AND NON-ALCOHOLIC BEVERAGES) ORDER, 1965.

I, PÁDRAIG S. Ó h-IRIGHILE, Minister for Industry and Commerce, having considered a report of the Fair Trade Commission under section 7 of the Restrictive Trade Practices Act, 1953 (No. 14 of 1953), as amended by the Restrictive Trade Practices (Amendment) Act, 1959 (No. 37 of 1959), in regard to the supply and distribution of intoxicating liquor and non-alcoholic beverages, hereby, in exercise of the powers conferred on me by section 9 of the Restrictive Trade Practices Act, 1953 , order as follows :

1. This Order may be cited as the Restrictive Trade Practices (Intoxicating Liquor and Non-alcoholic Beverages) Order, 1965.

2.—(1) A retail trade association shall not, either alone or with another or other trade associations, decide, recommend to retailers for adoption, or propose for adoption by retailers, the retail selling price of—

(a) intoxicating liquor, or

(b) non-alcoholic beverages sold in or from bottles or cans.

(2) A group of persons (other than persons who are members or officers of the same firm or company) engaged in the sale by retail of

(a) intoxicating liquor, or

(b) non-alcoholic beverages sold in or from bottles or cans,

shall not make any collective decision, recommendation or proposal relating to the retail selling price of such liquor or beverages.

(3) In this paragraph and in paragraph 3 of this Order " beverage " does not include milk, a medical or pharmaceutical preparation, or a beverage which normally is heated before being consumed.

3. A retail trade association, either alone or with another or other trade associations, or the officers, employees, members or agents of such an association or a group of persons (other than persons who are members or officers of the same firm or company) engaged in the sale by retail of—

(a) intoxicating liquor, or

(b) non-alcoholic beverages sold in or from bottles or cans,

shall not prepare, publish, issue, advertise or circulate, or procure the preparation, publication, issue, advertisement or circulation of—

(i) lists of retail selling prices of such liquor or beverages, or

(ii) circulars or other communications (whether oral or written) indicating or recommending, by reference to prices, price lists existing before the making of this Order or any other matter, alterations in the retail selling prices of such liquor or beverages.

EXPLANATORY NOTE.

The effect of this Order is to prohibit collective action by trade associations or groups of traders in regard to the selling prices of intoxicating liquor and soft drinks. The Order requires to be confirmed by an Act of the Oireachtas before it will have the force of law.
