BUSINESS NAMES REGULATIONS, 1964.

I, JOHN LYNCH, Minister for Industry and Commerce (hereinafter called "the Minister"), in exercise of the powers conferred on me by section 17 of the Registration of Business Names Act, 1963 (No. 30 of 1963), hereby make the following Regulations :—

1. These Regulations may be cited as the Business Names Regulations, 1964.

2. These Regulations shall come into force on the 1st day of April, 1964.

3. In these Regulations "the Act" means the Registration of Business Names Act, 1963 (No. 30 of 1963).

4. Whenever any act is required by the Act to be done by the registrar, such act shall be done by the registrar or by an assistant registrar or by any other officer authorised in that behalf by the Minister.

5. The fees to be paid to the registrar under the Act shall be as follows :

(a) On furnishing a statement of particulars required under section 4 of the Act, the sum of five shillings, and such sum shall cover the issue of one certificate of registration ;

(b) On furnishing a statement of change in the particulars registered as required under section 7 of the Act, the sum of five shillings, and such sum shall cover the issue, where necessary, of one certificate of registration of change in the business name ;

(c) By any person inspecting, under the provisions of section 16 of the Act, any documents kept by the registrar, the sum of one shilling for each such inspection ;

(d) By any person requiring, under the provisions of section 16 of the Act, a certificate of the registration of any person or a certified copy of or extract from any other document or any part of any other document, the sum of two shillings for each certificate, certified copy or extract.

6. The Forms set out in the Schedule hereto, with such variations as the circumstances in each case require, shall be the forms to be used under the Act.

7. The Business Names Rules, 1917 (S.R. & O. 1917 (No. 186) ) and the Business Names Rules, 1921 (S.R. & O. 1921 (No. 1029) ) are hereby revoked.

Failure, without reasonable excuse, to furnish the required statement of particulars within the time specified will entail liability on summary conviction to a fine not exceeding £100 ; any statement which contains any matter which is false in any material particular to the knowledge of any person signing it will entail liability on summary conviction to imprisonment for a term not exceeding six months or to a fine not exceeding £100, or to both.

" ' surname ', in the case of a person usually known by a title different from his surname, means that title."

" References in this Act to a former Christian name or surname do not include (a) in the case of a person usually known by a title different from his surname, the name by which he was known previous to the adoption of or succession to the title ; or, (b) in the case of any person, a former Christian name or surname where that name or surname was changed or disused before the person bearing the name attained the age of 18 years or has been changed or disused for a period of not less than 20 years ; or, (c) in the case of a married woman, the name or surname by which she was known previous to the marriage."
