DISABLED PERSONS (REHABILITATION) REGULATIONS, 1963.

The Minister for Health, in exercise of the powers conferred on him by section 5 of the Health Act, 1947 (No. 28 of 1947), and by sub-section (2) of section 50 of the Health Act, 1953 (No. 26 of 1953), hereby makes the following Regulations:—

1. These Regulations may be cited as the Disabled Persons (Rehabilitation) Regulations, 1963.

2. In these Regulations—

"the Act" means the Health Act, 1953 ;

"the Minister" means the Minister for Health;

"rehabilitation service" means a service provided under section 50 of the Act for the training of disabled persons for employment suitable to their condition of health and for the making of arrangements with employers for placing disabled persons in suitable employment.

3. These Regulations shall come into operation on the 1st day of August, 1963.

4. —(1) A health authority shall make a rehabilitation service available in one or more of the following manners:—

(a) by making such service, or part of such service, available in or at a health institution maintained by that authority which is approved for the purposes of this article by the Minister, or in or at any premises, workshop, farm, garden or similar place maintained by that authority;

(b) by an arrangement, approved by the Minister, with another health authority or with a joint board established by an order made under section 45 of the act, for the making of such service, or part of such service, available in or at a health institution maintained by that authority or joint board which is approved for the purposes of this article by the Minister, or in or at any premises, workshop, farm, garden or similar place maintained by that authority or joint board; or

(c) by an arrangement, approved by the Minister, for the making of such service, or part of such service, available in or at any other institution, premises, workshop, farm, garden or similar place.

(2) Payments shall be made by a health authority for services provided under an arrangement made under paragraph (b) or paragraph (c) of sub-article (1) of this article in accordance with such scale of payments as may be approved of or directed by the Minister.

5. Save to such extent as may be approved by the Minister, a health authority shall not make available under section 50 of the Act any service which a health authority are authorised to provide by or under any other provisions of the Health Acts, 1947 to 1960, or the Mental Treatment Acts, 1945 to 1961, or which a council of a county or a corporation of a county borough are authorised to provide under the Blind Persons Act, 1920.

EXPLANATORY NOTE.

These Regulations specify the manner in which and the extent to which health authorities are to provide a rehabilitation service under section 50 (1) of the Health Act, 1953 .
