MILK AND DAIRIES (FEES FOR BACTERIOLOGICAL EXAMINATION) (AMENDMENT) REGULATIONS, 1962.

The Minister for Health, in exercise of the powers conferred on him by Sections 15 and 50 of the Milk and Dairies Act, 1935 (No. 22 of 1935) as adapted by the Health (Transfer of Departmental Administration and Ministerial Functions) Order, 1947 (S.R. & O. 1947 No. 58), hereby orders as follows :—

1. These Regulations may be cited as the Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1962.

2. The Interpretation Act, 1937 (No. 38 of 1937) shall apply to these Regulations as it applies to the interpretation of an Act of the Oireachtas.

3. These Regulations shall come into operation on the 1st day of January, 1963.

4. In these Regulations

" the Principal Regulations " means the Milk and Dairies (Fees for Bacteriological Examination) Regulations, 1936 (S.R. and O. 1937 No. 16);

" the Regulations of 1956 " means the Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1956 ( S.I. No. 293 of 1956 ).

5. Article 3 of the Principal Regulations is hereby amended by the substitution of " fifteen shillings " for " ten shillings " (substituted therein by the Regulations of 1956).

6. The Table of Fees in the Principal Regulations is hereby amended by—

(a) the substitution in paragraph (1) of " one pound " for " fifteen shillings " (substituted therein by the Regulations of 1956) after "For each cultural examination";

(b) the substitution in paragraph (2) of " fifteen shillings " for "ten shillings " (substituted therein by the Regulations of 1956) after " For each serological examination ";

(c) the substitution in paragraph (3) after " For each biological examination " of

" (a) if two animals are used—three pounds;

(b) if one animal only is used—two pounds "

for the following (substituted therein by the Regulations of 1956)

" (a) if two animals are used—two pounds ten shillings;

(b) if one animal only is used—one pound ten shillings";

(d) the substitution in paragraph (4) of " ten shillings " for " seven shillings and sixpence " (substituted therein by the Regulations of 1956) after " For each microscopic examination ".

7. The Milk and Dairies (Fees for Bacteriological Examination) (Amendment) Regulations, 1956 ( S.I. No. 293 of 1956 ) are hereby revoked.

EXPLANATORY NOTE

These regulations provide for increases in the fees payable to bacteriological examiners for the examination and testing of milk samples under the Milk and Dairies Act, 1935 .
