AIR-RAID PRECAUTIONS (APPROVAL OF EXPENDITURE BY ESSENTIAL UNDERTAKERS) (AMENDMENT) (No. 2) REGULATIONS, 1944.

I, PROINNSIAS MAC AODHAGÁIN, Minister for the Coordination of Defensive Measures, in exercise of the powers conferred on the Minister for Defence by section 48 of the Air-raid Precautions Act, 1939 (No. 21 of 1939), and delegated to me under section 6 of the Emergency Powers Act, 1939 (No. 28 of 1939), as amended by section 10 of the Emergency Powers (Continuance and Amendment) Act, 1942 (No. 19 of 1942), and of every and any other power me in this behalf enabling, do hereby, with the concurrence of the Minister for Finance, make the following regulations, that is to say :—

1. These Regulations may be cited as the Air-raid Precautions (Approval of Expenditure by Essential Undertakers) (Amendment) (No. 2) Regulations, 1944.

2. The Air-raid Precautions (Approval of Expenditure by Essential Undertakers) Regulations, 1940 (No. 180 of 1940), as amended by the Air-raid Precautions (Approval of Expenditure by Essential Undertakers) (Amendment) Regulations, 1942 (No. 72 of 1942), shall have effect as if the following Regulation were inserted after Regulation 11, that is to say :—

" 11A. Where—

(a) a person has been declared, by an Order made under sub-section (2) of section 4 of the Act, to be an essential undertaker for the purposes of the Act, and

(b) that person, during the period between the passing of the Act and the date of approval of that person's air-raid precautions (essential undertaker's) scheme, incurred expenditure for the purpose of making provision for the continued functioning of that person's undertaking in the event of attack from the air,then, notwithstanding that the prior approval of the Minister was not obtained to the making of such provision and notwithstanding anything to the contrary contained in these Regulations, such expenditure may be approved for the purposes of section 46 of the Act, if and in so far as the Minister is satisfied that such provision was in all the circumstances reasonable and proper."
